Please help me on this:

My friend is willing to be a joint sponsor. He has past three years taxes filed (2010, 2011, & 2012). He made around $35,000 which is above the poverty guidelines. But it is been 6 months he is not working there anymore because he got injured and he is getting unemployemnt from the government. Now he is working at a Pizza place, but doesn't make enough. My question is, can he be a joint sponsor since his last 3 year taxes were above poverty guidelines?

hi,

unless he can add assets then no, he also has to currently be making over the poverty guideline. he will need a letter from an employer stating how much he makes.

he needs to be able to cover the beneficiary in case he or she becomes a public charge, he needs to also currently be making the 125% over the poverty line and it will be estimated on how much he makes monthly.

What matters is current income. If his 2012 ITR shows he's employed in a certain company but in reality he no longer works there and no longer earning the income reflected on the ITR, he can no longer be a joint sponsor unless he's earning more on his new job/new employer.

If his current income on his current employment is below the poverty guideline, he can no longer be a joint sponsor. Might as well find someone else.

My fiancee went to Uzbekistan Consulate with I-864A not I-864. I also used a joint sponsor. I-864A is much simpler compared to I-864. My fiancee was approved. We had two I-134 for my self and the joint sponsor and 1 I-864A which is a contract between the petitioner and the joint sponsor. My uncle did not file income tax before 2012 so we only used 2012 return (1040). Yes the current income he is getting is higher than the poverty guideline. Do not forget to get Tax Transcripts (copies are fine, just call IRS and talk to a real person and ask them to fax it for you) for both yourself and your joint sponsor. Hope I gave you some helpful info.
