Does USC Spouse need to file a G-325A with I-485 adjustment from K1 & K2

Hello VJ Friends,

We are getting ready to send out our AOS package and I have a question about something that is not clear to me....

Do I as the USC spouse (K1 petitioner) need to submit a G-325A for myself?

I will be including a G-325A for my wife (the intending immigrant) and another G-325A for my stepson (Child of Intending immigrant).

Good question.

The answer may depend on whether you get an interview or not, and perhaps WHO interview you.. I believe the Guides are correct. The AOS process is for the new immigrants (K-1 and K-1, in this case), therefore the need a new G-325A seems appropriate.

However, at my wife (K-1) and stepson's (K-2) AOS interviews in November 2012 in Seattle, the IO required me (USC) to fill out another G-325A before the IO would proceed with the interview. It is not listed in the I-485 instructions (see Item 8, page 4):

Rather than argue with the bonehead bureaucrat, I scribbled out another G-325A. The legible computer-printed G-325A that I had submitted with the original I-129F petition was in the paperwork. The only thing different between the two G-325A forms was that I had to list my newly married spouse on the appropriate line. Go figure.

I haven't heard of very many similar instances of what we encountered. I would say, follow the I-485 instructions.

I hope the USC (Spouse) does not have to submit a G-325A for themself. I did not see anything in the instructions about that one. We submitted all the paperwork a few weeks ago. Elizabeth received her biometrics appointment letter already. She has the bio on 12/3/13 at 10:00am. Lucky for us the biometrics office is only 40 minutes away. I guess we will wait and see if we receive a RFE on the spouse USC G-325A.
