Hi every one I hope you can help me, I want to file for k1 for my fiance from philippines, but im worried about my in come. I have income tax for 2013 and is more than the required amount, but I had to leave my job last july. Then I started working again just last week but I get paid by cash. If I file this month and hopefully approved, is it ok if I wont be able to show paystabs, and or letter of emplyment? Would I get denied? Also is it ok to use a co sponsor? Im getting confused, they said in the philippines, they do not allow it. Please please help :(

Hey Shane, you will have to show verifiable proof of income. Being paid by cash cannot be verified. I mean you could show bank statement's showing deposits and indicate you are an indepdent contractor, but you would still need a letter from an employer stating as such.

Last years tax return is going to help, but the embassy wants to see that you are making above the poverty guidelines moreso currently than in the past.

Manila typically does not accept a Co-Sponsor at the k1 level. If it is a family member, I would suggest them writing a letter indicating such and getting them to fill out an i-134 as well in conjunction to yours.

I'm sorry but the burden of proof is on you, and without substaniating income it is going to be difficult.

Hi thanks for the replies, the co sponsor would be able to provide everything and sign everything, the co sponsor would be my fiance's uncle who lives in alaska and is a us citizen. I tho, live in new york. Would that help? Also even if I would be able to get a letter from my employer saying they are paying me by cash, would that help too? Thanks again :)

Yes, you can use that co-sponsor because he is USC but I am not sure if Manila embassy will accept co-sponsor, really no harm trying!

You can get a letter from employer stating your job, when did you start working and state that you are Permenant or not..

I don't think you can take into account of cash job because it is not recorded in W2? Do you pay taxes for your cash job? Do you make enough for poverty on your cash job?

Yes it wont be recorded in w2, but I will be paying my taxes, self employed, and yes it is above the required salary. I worked from jan 2013 to july 2013 with w2. So when I file for 2013's taxes I have the w2 plus the one im filing that is off the books. Which would prolly add to around $40-$50,000. My concern is that, I wont be able to show paystabs since im off the books. And also no letter from employer. But I would have bank statements showing that I deposit money every week. Do you think this would be ok?

Yes bank statement is okay..

Oh! You are self employed? My fiancé is self employed too. We are going to take ITR for interview.. Hope that helps

These are all good "technical" responses but no mention of the actual cost of k1. Will you be able to pay all the fees?

Have you or are you going to visit her.

The I-129 is just the tip of the expense chain.
There are many more costs to incur. Just so you are aware.

Yes I do have money to pay for everything, and i am working, the problem I have is that I am being paid in cash so there are no paystabs and letter from employer.

Complete tax return with all forms, schedules W-2s and/or 1099s is what you use to prove self-employment income. If you file the petition now, then you will most likely have enough time to file your 2013 taxes and provide that along with the I-134 for the K-1 visa interview later. If your Total Income on line 22 of the 1040 form shows $40-$50k, then you will have no issues with the income requirement unless you have a larger household size.

There are many reasons that US Citizens should file and pay their income taxes like the majority of us do. This is one prime example. I have been filing and paying income taxes since I was 17 and am now 56. When people work for cash who pays for the streets to be repaired, etc???? Us taxpayers do my friend. Proud Americans who live in the greatest country in the world.
