Hi everyone, I just got informed about this site. I'm new here and need some advice for my sister who wants to change her status after her husband abandoned her with a baby. She is currently on B1/B2 visa and just had the baby last month here in the US for this man whom she married in the US. Her husband is a US citizen. She occasionally visits here but her husband refused to file for her permanent residence instead preferring she remains in Africa. A couple months ago, he informed her of divorce, but promised to care for the child and then he cut off all communication lines. Please, is there anything she can legally do on her own to remain in the US. I am only a permanent resident and have been accommodating her and the baby. I will be grateful for any suggestion. Thank you.

Sadly your sister doesn't have to many options. It is her husbands responsibilty to file for her. If he doesn't do this, there is not much she can do in this point. I hope someone else might have other advice for your, but for the moment there is no legal way your sister will be able to stay in the US.

It's amazing how many questions can be resolved with a 2 minute Google search...

If you naturalise then you can sponsor her, but that will be 12 or so years, so for now she has to go home.

If the child was born in USA then he/she is US Citizen. The child can sponsor the mother when he/she turns 18.

Actually sibling petitions are top in the line to be eliminated in immigration reform so you may not have that path when you become a citizen. She may have to wait until her child turns 21. Make sure she doesn't overstay her visa

This will not be over quickly. You will not enjoy this.
