I 129F Denial

I submitted an I 129F application for my gay partner in Indonesia.

I was granted expedited status due to my cancer.

My petition was denied. I am waiting for letter I 797 ( don't know which one)

My major concern in this process is my being unable to travel and my partner is very

poor and a gay MUSLIM. We tried 2 times to get visitor visa. Both times denied 214B.

First denial-- didn't prove he would return,

second denial---couldn't travel to show he left country and returned. he is too poor!

So we waited for doma to be tossed and went through this procedure. We submitted

Request for Evidence Response Review info. DENIED!

So I assume its because we have not met in last 2 years.

Any ideas?

Yes, it is a requirement to have met in the last 2 years before filing.

Have you requested a waiver of meeting due to your severe illness and inability to travel ?

I doubt that it would be granted even though you got expedited.

Expediting will not automatically waive meeting requirements to meet.

Perhaps you could both meet in a third closer country that does not require prolonged travel.

I am sorry to hear your denial. I was denied for B-2 visa in 2010 due the fact I had an American boyfriend (my now fiance). US embassy in Jakarta is well known for being very strict and rarely to issued a B-2 visa even though you have a lot money. I am not poor, I have a good job, plenty savings, property, insurance, and the consular officer did not even bother to see the bunch of papers I brought because I wrote there "I want to meet my boyfriend".

If you don't mind my asking, how bad your cancer is? Why not trying to visit Indonesia like other poster said?. Indonesia is one of most populous Muslim countries but gay people are not prosecute here. So you'll be safe. Where is he come from?

Again, if you don't meet in person yet, no matter how hard you try, you'll come to no avail. The only thing you should do is meet in person as the requirements ask. Good luck.

If he's really poor, who will pay for all expenses when he comes to visit you?

I will get it from family. But can not afford all the trips

Have you ever met ? How did you meet and what other red flags does your relationship have. ?

I assumed they sent a request for evidence that you met in the last 2 years to which you somehow responded and then were denied. EIther you didn't present your case well enough or you have too many red flags. Has you friend tried to get a visa to Canada or Mexico ?

That's the thing. Even if you get approval of your I-129F, the next step is that can you provide I-134 or affidavit support for him when he has K-1 visa interview? I heard US embassy in Jakarta accept co-sponsor but I am not positive about that.

I'm sorry for your horrible circumstances, the meeting within two year rule...there is no getting around it. you must meet, and prove you have met. Good Luck!

You must make 125% of the poverty line or you will need a co sponsor.

Don't worry about him being poor. As long as you make enough to support him thru the K-1 process is all that matters to the government.
