I just recieved a Jury Summons- although I am not yet a Citizen

Hi all, I have my civics test and interview this coming Monday.

A few days ago, I received a jury summons in the mail telling me to report for Jury Duty on Dec 3. I know that currently as a non USC I am exempt from Jury Duty but given that I am very near the end of the naturalization process, I am not sure if by Dec 3 I will be a USC.

My husband says I should just respond now, saying I am not a USC and send it in the mail. But part of me thinks that maybe I should bring it with me to my interview and ask the IO how to proceed as I am afraid it might look like I am 'trying to get out of jury duty' or that if I become a USC in by the time they process my reply, it will look like I lied in the responce.

Reply now, with "Not a USC"; anything else equates to representing you are a USC and that is a big no no. It is immaterial what you will be on the day of the jury duty summons, they draw this requests out of driver's licenses records usually. There have been other posts here about this and I sort of recall one in which now the person was in a deportation process.

I can see your logic of waiting until the day of the test; but I think is safer to do it now.

Just enclose a copy of your green card and mail that in with your circumstance with even a note, its against USCIS federal regulations to serve on jury duty as an LPR. Amazing the number of city, county, and state employees that don't know anything about immigration. And never even heard of the USCIS.

Hi there, I agree that that's it odd how many government agencies seem to be so closed off from each other.

There is a exception box on the reply summons for jury duty that does allow me to check off that I am not a USC and to write my nationality. If I was months and month away from citizenship or not in the process, I would check it off and not think twice about it. ( I also got a jury summons a couple of years ago and that is what I did)

My concern is if I am lucky enough to get sceduled for my oath cermony in Nov, and I report my new status to SS and the DMV which will verify USC status- and then afterwards someone from the jury comission checks my status it would have looked like I lied.

But I suppose, if that did happen it would come down to the fact that was true and accurate when I wrote it.

They send out jury duty notices from magazine subscriptions and the like. It's completely correct to tell them you are not a USC. They messed up, not you.

I would advice you to not to gamble with that because USCIS can get back on you and tell you that you knew about the jury duty and didn't respond to them knowing you are not a citizen at that time. I would tell you to send it back with the explanation that you are not a US citizen even though you might be a citizen that time. Good luck.

It happened to me once, I called the courthouse, told them I didn't understand why they sent me one since I'm not an American citizen, they told me to ignore the summons and discard it, which I did and never heard anything again. You may want to return them their paperwork with a note saying you're not an American citizen, just so there's a paper trail.

I got one in the mail on the Monday of the same week my oath ceremony was scheduled. Dropped the response in the mail immediately with a copy of my greencard.

A couple months later, I got another summons in the mail...I kept that appointment since I was now a citizen.

May 20, 2008: Green card approved

N-400

February 22, 2011: Sent N-400 VAWA package

February 23, 2011: FedEx package signed for and delivered

March 15, 2011: Email NOA

March 15, 2011: Check cashed

March 17, 2011: Email re: Fingerprint Notice mailed out

March 18, 2011: NOA received (Notice Date 03/14; Priority Date: 02/23)

March 23, 2011: Biometrics notice received for 03/31

March 31, 2011: Biometrics completed

July 5, 2011: Online status: Now scheduled for interview

July 12, 2011: Received interview letter finally!

August 11, 2011: Interview Date (Garden City) - PASSED!!!

August 15, 2011: In line to be scheduled for Oath

August 16, 2011: Oath scheduled, notice sent

August 20, 2011: Oath notice received

September 15, 2011: Oath ceremony @ 8:30 AM

September 17, 20011: Passport application

I got one a few months ago when I didn't even apply for citizenship yet. I went online and it took me a couple of minutes to fill something out that said I can't do it. Reason : not a citizen, green card holder and I put in my card's #. I got an email the next day saying they received it and I'm all set

You may want to return them their paperwork with a note saying you're not an American citizen, just so there's a paper trail.

Not sure how your summon was but most of the summons have check box indicating you cannot vote in US – so you are supposed to mark that and send it back.

You cannot just discard the summon.

They just pull the names from DMV database.

That was one of my friend's advice " just throw it in the trash "- not a very good one. It doesn't really take that much time out of your day to reply why you can't do it. Also, probably not the best idea for me to ignore it, if I'm planning on being interviewed for citizenship in the near future. Not sure they can see it if I ignored the note or not, but if they do somehow have access to it , then it doesn't really look good that I blew them off
