Hello dears;

i am new to the forum. I am looking for advise in the following matter:

1. I have been legal permanent resident of the USA for about one year. (my USC daughter petitioned me, because i entered the USA as a tourist)

2. now that I am legal permanent resident i want to file I-130 for my daughter who is 16 years of age and she entered the USA with tourist visa on 2011 and she stayed here.

3. My question is: if she will need the I-601?

She doesn't need a waiver now if she has a visa number available , because she is under 18 years old,but you said you will file I-130 , but until you file , they approve and a visa number becomes available she will be over 18 years old and then she will start accruing unlawful presence.

She's 16 years old NOW?

Visa for children of LPR are no longer "current" so she cannot adjust status in the US. Better to send your daughter back to her home country while she waits for the visa. You can file i-130 now.

Since she is under are 18, she is not accruing any days of unlawful presence.

You are abusing the immigration system, but fortunately there is no penalty for your daughter.

How can she adjust status when she has none?
