N-400 denial because of immigration error!!!

There are two separate issues here: a possibly incorrect date on the green card, and the denial of the N-400. I don't think you'll be able to reverse the N-400 denial because USCIS were correct to deny it, but they may have put the wrong date on your green card. If you can get the green card's issue date amended then you may become eligible to file for citizenship again.

You should speak to an experienced immigration attorney, as you are now well past the point that this can be DIY'd.

Timeline

When we received the 2 year GC, it was dated with our interview date in 2006. We received it on my mom's birthday in 2006, which was bittersweet because she had passed away in September 2006.

I guess they put whatever date they feel like.

The category on green card is correct IR6 is 10 year card for spouse of US Citizen. Thats what my spous's 10 year card says.

ok so I got a certified mail just now,had to sign for it. it says am denied and all the things needed to be eligible,i meet that requirements.on the other page it says it appears that your conditional resident card was issued with the incorrect residence start date of april 20,2010,therefore you may be eligible for a free refund of your form n400.if you believe you can overcome the grounds for denial,you may submit a request for a hearing on form n-336. you maybe be eligible to apply for naturalization again any time after October 6,2013,based upon the 90 day early filing .

I don't know what I should do,just wait and refile again or request for a hearing? I don't even know what official date my residency started because they didn't actually say I became a resident such and such date other than I should file after October 6,i am do the math but they could atleast say u ur resident date was such n such.if I do refile and go to another interview what other mistake they gonna make and tell me.i don't know when my resident date is,offically. so the question is,should I refile or request a hearing,since immigration made the error?

just called the 800 number n the wait time was 200minutes... they are so rude am asking to speak with tier2 and she refused to transfer me and demanded I should make an infopass. I spoke with someone in tier2 couple weeks ago and they gave me a confirmation number so whenever I get the official denial letter in hand,i can call back and give that number,i told her I had the number and she said go make an infopass and I told her,please transfer me n she hung up.anyways I called back n spoke with someone else and they said they cant help me ,the office that made the error should fix it. the lady said to file for an appeal I would have to pay $650 ,just to get an hearing.i asked what was my resident date on the file,one told me its april 20,2010 which is the date on my card and another person there said they cant give me that information,i have to file a form and request for my information and I have to pay to file to know what my actual resident date is!!!

January 6, nine months after the interview. He lady at the info pass said the guy "forgot" to sign it so it can be approved. I made a lot of info pass so I guess that's y they finally remember to sign I guess.i hope they get it right this time.
