Hi all,

I have a family's friend would like to know if he can file for I-129F even if he's 63 years old and his girlfriend 59 years old. Is there age's limitation on that? I have tried to research online but no luck on that.

Only if there are US laws forbidding those over the age of 60 to marry that I am not aware of. For the I-129F, they must be free and legally able to marry within 90 days of entering the US with a K-1 visa, and have met face-to-face at least once within the 2 years prior to filing the petition.

Only age restriction I know from USCIS is the person filing must be 18 years or age or older. I think your friend is safe wink.png

I know a fair number over the age of 63 who filed the I-129F petition (me included)

No problem filing... However I have read in other threads of cases where someone filed for foreign parents and because of the risk for medical issues, they required showing proof of medical insurance.... Just a thought...

"Legal to Marry" Is it legal for a 63 year old to marry a 59 year old? YES

You are good to go...EXCEPT the woman he petitions must be his fiancee, there are no visas for girlfriends.

My fiance was 64 and I am 50. We were successful in getting our K1 and we were married in the US 6 weeks ago (on his 65th birthday).

Hello. Everyone is correct and also incorrect answering this question. US always follow the local laws and customs. I see that you are a Cambodian national. Cambodian law requires you must be age of 50 or under and have a minimum income of $2500 per month to be able to marry a Cambodian Citizen. It's not a problem in the USA but US Embassy always follow local law. So if you or someone either apply K-1 or I-130 and USCIS and NVC approves without knowing local law, you will definitely be denied based on ineligibility at the Embassy during interview. So, before knowing the requirements, I don't think everyone should jump the gun and giving advise like this is which is not helpful and may cause severe problem later on if he follows everyone's advise.

Here is a link to US Embassy in Phnom Penh's website clarifies it. Even though it says getting married in Cambodia, they still follow that in K-1 visa as well.
