Hello,

My online status on uscis website states that On August 20, 2013, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires.

I have not received any physical mail yet. But I am highly surprised to see this since I read everything meticulously and send all of the possible documents. Below is the list of all my documents for i-485 I sent in my package along with i-130, 1-765. I will appreciate if anyone has any idea what would be missing?

o This covering letter

o Form G-1145 e-notification of Application /Petition Acceptance

o Check: for the amount of $1070.00 for Form I-485 and Biometrics (payable to Department of Homeland Security)

o Form I-485: Application to Register Permanent Residence or Adjust Status

o 2 Passport Photos of beneficiary (in Ziploc bag)

o Form G-325A for beneficiary’s name

o Form I-693: Medical Examination of Alien Seeking Adjustment of Status (In Sealed envelope) from civil surgeon

o Photocopy of beneficiary’s birth certificate as proof of birth date

o Photocopy of beneficiary’s passport (biographical page, F1 visa page, all stamped pages)

o Photocopy of beneficiary’s valid I-20 form as evidence of legal valid status

o Photocopy of beneficiary’s valid I-94, front and back as evidence of current status

o Photocopy of Marriage Certificate as evidence of relationship

o Form I-864: Affidavit of Support, filled out by my sponsor

§ Copy of Employment verification letter

§ Copy of last 6 months pay stubs as proof of employment

§ Copy of Federal Income Tax Return for last three years (2012-2010)

§Copy of W-2 for the year 2012

o Supporting documents from the principal immigrant Me.

§ Copy of my employment verification letter as a proof that the income will continue from the same source after he obtains lawful permanent resident status

§Copy of recent 6 months pay stubs as proof of employment.

§ Copy of my Federal Income Tax Return for last three years (2012-2010)

§Copy of my W-2’s (2012-2010)

o Form I-864: Affidavit of Support, filled by joint sponsor Mother in law

§ Copy of US passport (Biographic data page) for joint sponsor as a proof of US citizen

§ Copy of birth certificate

§ Copy of Employment verification letter

§ Copy of last 6 months pay stubs as proof of employment

§ Copy of Federal Income Tax Return for last three years (2012-2010)

§ Copy of W-2 for the year 2012

You can drive yourself crazy trying to figure out the "woulda, coulda, shoulda" of an RFE. wacko.png Wait for the official RFE letter to definitively find out what they want.

Here is to hoping that it will be something very simple and easily remedied.

Hi Panda1,

Do we really have to send proof of employment? You sent Copy of last 6 months pay stubs and Copy of my employment verification letter. Is that really needed?

I have already sent all these supporting document with my AOS package last month. What I am trying to say is my online status indicated that uscis has send me a RFE because something is missing in the documents listed in OP. I wonder what that is since I haven't received the RFE in mail yet?

Yeah you are right. I will have to wait until I get it in my mail. Hope its really something simple.

Honestly it could b anything. I'm reading all ur docs and u didn't mention a g325 for both the petitioner and also the applicant. And btw u need more than two pics for the applicant

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

Just from the first glance:

  • I-130 + 420$ + supporting evidence + pictures
  • G-325A for petitioner
  • proof of citizenship for petitioner

Agree, those seem to be missing.

Also wondering about the supporting documents for the I-130, including additional photos of the beneficiary, and photos of the USC. Not to mention relationship evidence to go with the I-130.

Also OP, did you submit the i-131 and I-765? Just out of interest.

Why did you include these? Did you use your income on the I-864? Did you include proof of your legal ability to work?

Also, I would have sent IRS transcripts instead of returns and W2's.

The RFE is for i 485 so I mentioned only the documents I attached to my i485 in the OP. I have also send all other forms and supporting documents in the package (so I-130 + 420$ + supporting evidence + pictures, G-325A for petitioner, proof of citizenship for petitioner etc is also sent in the package)

Please read the OP posting carefully before making any comments. I have included i130, i484 and i765 in the packed. I used my income in the i-864 and of course if I am sending w-2 and tax return transcripts and payroll for my income I have legal ability to work. For year 2012 I used IRS transcritps and for 2010 and 2011 I used tax returns which is optional anyway.

I used my income in the i-864 and of course if I am sending w-2 and tax return transcripts and payroll for my income I have legal ability to work. I did, you did not mention the I-131, you also did not state what documents you included with the I-130, that could be a problem. You didn't state you used your income but did state you sent your documents. some people forget to include proof of legal ability to work, assuming that USCIS "should know".

i131 is optional so I did not sent it. RFE is about my i485 so I wonder if it has to do anything with i130. I send my i-20 which shows my legal ability to work. Another thing is I have not received the RFE in the mail. Its been over 10 days from the date thye send it. I don't know if its lost or the online thing is an error? Thats another mystery
