Have your friend follow the guide Hypnos posted. Regardless of what some people on this site think, it IS legal to AOS from a visitor visa or VWP. They will have to provide evidence of a bonafide marriage (joint bank accounts, etc.).

It would be hard to convince me if she came over for a 30 day visit and decided to get married all of a sudden.

Fortunately, they don't need to convince you. In fact, they don't even need to convince USCIS.

If your friend is from Haiti, and since you said she has a visitor's visa good for another 6 month; I would HIGHLY suggest she adjusts status while in Haiti. I know of two recent similar cases where the spouse got denied and got a ban because they failed to prove that they did not intend to stay.

Chances are she will get a renewed visitor's vida and can travel during the wait... that's just my opinion. But if they do decide to adjust here, follow the advice some vjers have posted on this thread!

Adjusting through a Visitor Visa is the most common route.

1. You can only adjust status while in the US

2. Any links proving someone was 'banned' (or denied) because of intent would be helpful, since the adjuticator's field manual specifically states they cannot deny because of this.

It is much safer to apply for CR-1 have her go home till the process is finished (approx 6 months). I know no one wants to be apart, but you will not be taking a chance.

Of course you will be taking a chance if you did this.

Rounds tickets are way less expensive than one way, so that is hardly a criterion.

Does she have a job she has to return to? Can she prove she quit AFTER the wedding, not before coming to the US? Same with rent and so on.

Round trip tickets are NOT less expensive than one way, AT ALL. Maybe you meant less expensive than double the price of a one way ticket... if they were, one way tickets would not exist, everyone wanting one would buy the round trip.

Um, what, have you ever travelled? A lot of people find one-ways that are more expensive than a round trip. Most people do buy round trip.

Um, what, have you ever travelled? A lot of people find one-ways that are more expensive than a round trip. Most people do buy round trip.

Every time I had to do a one way trip I checked the round trip and it was more expensive. I'm sure there are exceptions, since I'm sure they only do "sales" for round trips. But the claim "round trips are cheaper than one way" is simply false, that was all I wanted to point out (my phrasing was not the best, since it looks like i'm saying the equally wrong statement "one way is cheaper than roundtrip always").
