According to some question about my marriage.it is legal 299% in my country it went throw legal process beginning with the ministry of justice and judge and...and.....here is the message of USCIS:

It appears from the evidence submitted that your marriage to X is by proxy.in order for a proxy marriage to be recognized for immigration purposes the marriage must be consummated subsequent to the marriage.therefore,additional documentary evidence is required.

After that,the said subnet evidence that u and my wife have met each other in person at some point during the period from march to may.so I was still here in Boston I met her 3 months later.

I was wondering if my marriage was illegal they ganna tell me in like one line.we don t accept proxy marriage? What do you think friends.?

i note the word 'consummation' was used, by USCIS.

Now what are you going to do, to prove consummation prior to I-130 filing?

If you have a legal marriage certificate from Morocco you should be good as far as the legal marriage goes. The problem is USCIS will only recognize a proxy marriage (any country) if the marriage was consummated. You did not have a legal marriage PLUS consummation when you filed. NOW you have a legal marriage in the eyes of USCIS since you have been together.

You need to withdraw your existing petition and start over, it has no chance of being approved.

Possibly. You're really starting from scratch. The old petition won't make the new one any faster.

would it take 14 months again? Likely, as the petitioner in the USA is a green card holder, not a USA Citizen.

Your new petition may be faster because F2A category is current now. But that is not because you had an old petition. It's still going to take about a year, at least.

Why would you refile without evidence? When you file, you need to send evidence of your legal marriage and your physical meeting.

'Evidences' are listed in the I-130 instructions.

You can always make the choice to not follow the directions for this form, but I do not advise it.

When I said evidences I mean pictures of wedding ceremony,passport stamps when we were together,the CD of our ceremony.can I send all these with my refilling file?
