My wife and I are in the process of removing conditions (temporary to permanent green card) and we had recieved a RFE. On this RFE one of the things that they wanted to see was a state ID or drivers licence. She has been here 3 years and has attempted (and failed) the drivers test on 3 occasions. Her self confidence is shot and after lots of money spent on drivers training, she still feels she does not want to drive.

So when the RFE arrived we decided to just go get her a state ID and be done with it.

This morning we wnet to DMV with her expired green card, the letter explaining that her status is in process and she may travel, etc. (I am forgetting the number of this document) and her SS card.

She was flatly denied for her application. We were told that the USCIS is supposed to send another document after the green card process document, that would allow DMV to issue her a state ID.

Oddly enough, this mystery document was never mentioned when my wife took the drivers test.

Our RFE is due in about 5 weeks now and the immigration attourney we spoke with strongly suggested compling with the state ID request, but now it looks like the only way the state will issue an ID is with a valid green card, whcih we may not be issued without a state ID.

We have never recieved anything other than an RFE. Does anyone know what document the DMV might be referring to? They were unable to give me a title or document number for what they require.

Didn't you receive the NOA1 receipt notice for the I-751 which served as the extension of her legal status for 1 year when ROC is being processed?

Yes, that is the document we brought in along with her expired green card. DMV told us we needed "the letter they send you after this one". I have no idea what that might be.

I don't know which state you are from. Each state DMV has their own rules.

Otherwise, make an infopass and get her passport stamped with I-551 to prove her legal status validity.

Talk to someone higher up, e.g. a supervisor at the DMV again.

I will try to make an infopass appointment, but I don't know if we have time. The RFE is due Sept. 19th. and it takes weeks to process the ID alone.

I would go to another DMV office. It sounds like both do not know what they are doing. They want to see the expired GC and the extension letter which IS what you showed them, but for some reason they must not be able to read. Either that or they want you to have an unexpired GC. If you go to the CA DMV website and scroll down to applying for an ID card and then follow the link to the types of ID required for date of birth and lawful presence, they will accept the GC and the I-797. I would not bother the USCIS with this as this is a problem of untrained DMV workers.

Absolutely - it is best try at a different DMV Office hoping for the best.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)

10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Do they definitely want the ID or are they just looking for more general proof of relationship? If you get it now it will show that you got the ID just for the RFE when they are looking for information previous to you applying for ROC.

This worries me... Right now my husband and I live in Oregon and he has a Oregon Driver's License... Although we will be moving to California in September, we are in the middle of ROC and I don't think his ROC will be approved by the time we move. Now I'm worried the DMV will not issue him a California license until he receives his 10 year green card.

I hate reading all these stories of having a hard time with jobs, getting a driver's license or state ID issued and/or traveling using the extension letter. It clearly says the green card is extended for a year and that you can work and travel, yet I read so many stories like this on Visa Journey.

My husband is in Finland right now visiting friends and family. I hope the airlines don't give him a hard time when he flies back home. He has the original extension letter with him and his expired green card, so I know he has everything he needs to come home.

The RFE is not asking for a DL. It is asking for more proof of a bona fide marriage. The DL can be shown for address. Any evidence created after the RFE will have no value, as it will appear you are just doing what they suggest to get the GC.
