Hi Guys,

I file a petition of CR1 for my wife and am preparing affidavits of support.
I really need to know what I should file for the Affidavit of Support.
Visa journey stated that Affidavit of support requires copies of the past 3 US tax returns.
I've been in Japan (I moved US in May for my new job) and for this reason, I've have no job experience in US before.
I already have past 3 years certificate of tax payments when I had worked in Japan.
Tell me these documents meet the Affidavit of support required in I-864.

I really appriciate for your support.

I already sent the I-864, but I have a similar question on 2010 I didnt work because I was in school. I started working 2011 middle of the year or less so I just earned about 9k, in 2012 I got 29k. For the I-864 I didnt explain why I earn 0 dollars back in 2010 will they ask for a co-sponsor or will I get a checklist I been thinking of this the whole weekend and been worry... Hopefully not, I dont want to delay my case :S

Like Ozz said, if you're a U.S. citizen and you've been making a significant amount of money, you were probably supposed to file your taxes even while you were in Japan. If that's the case, then the rules say that you have to file the missing tax returns before they'll consider your I-864 (it's in the official instruction booklet PDF, p. 6). If for whatever reason you were actually not required to file your taxes in any past year (check the "Filing Requirements" for form 1040 on the IRS website), then you can attach a letter explaining your situation plus evidence for your exempt status.

The tax documents from two and three years ago are optional, though I'd also like to know under what circumstances it's recommended that we send those.

Removal of Conditions:

2016-09-27: I-751 removal of conditions petition sent (with fee waiver request)

2016-09-30: I-751 petition delivered to California Service Center

2016-11-01: Informed in USCIS customer service call that they had no record of receiving our petition, but that it might still be languishing somewhere in fee waiver limbo

2016-11-01: Filed I-751 again, this time with payment check instead of fee waiver request (sent Priority Express)

2016-11-03: Date on I-797 Notice of Action (received 11/7)

2016-11-09: USCIS mailed out denial of our original fee waiver request, with denial letter dated 2016-11-02

2016-11-19: Biometrics appointment notice issued, for 2016-12-07 appointment

2016-11-26: Second biometrics appointment notice issue, for 2016-12-16 appointment (see this thread)

2016-12-07: Biometrics appointment. Allowed to complete biometrics despite mix-up on their end (again see this thread), but some people had to come back for second appointment date.

2018-05-01: Notice that our case was transferred to National Benefits Center in Lee's Summit, MO

2018-06-11: Approved after N-400 interview in Portland, OR (they seemed to be waiting for that before bothering with it)

 

Citizenship:

2017-12-11: N-400 Application for Naturalization submitted online while still waiting to hear back on I-751, received same day

2017-12-15: Biometrics notice

2018-01-04: Biometrics completed, on appointment date (Portland, OR)

2018-02-28: Interview scheduled for April 12 in Portland, OR

2018-03-01 (approximate): We sent in a letter requesting that the interview be rescheduled to after June 8, due to combination of work and family travel plans

2018-03-07: Notice that our April 12 interviewed had been "canceled" (pending rescheduling, but the letter didn't actually say that; officer at InfoPass later explained that interviews aren't scheduled until five or six weeks before the interview date, so they were waiting until closer to our requested rescheduling window)

2018-05-03: New interview scheduled for June 11.

2018-06-11: Citizenship interview - approved!

If you were required to file and did not, then you need to file your back taxes now. If you were not required to file in any or all of the last 3 years, then you need to provide a statement as to why you were not legally required to file in those years.

You only need to provide the income total from the last 3 years. Only a copy of the most recent year is required with the I-864. If you feel the older tax returns can help prove your ongoing stable income and that the intending immigrant will not become a public charge, then you can include those too.
