I'm very happy to report that my I-130 petition for my Australian spouse was approved today! I think I was one of the first stand-alone I-130s to file - I filed the day after DOMA was repealed - and it has taken 214 days from submission to approval, and 31 days since the petition was transferred to the Texas Service Center.

We still have 3-4 months to go - but we are so excited!

Hi Everyone...it's been almost two months since we posted and it's great to see the progress keeps rolling for us same-sex couples. Congratulations!

We have a quick tax question and thought someone here might have been in the same situation. My husband was out of status for several years and worked using his ITIN. He had taxes taken out but never filed returns. I'm guessing he didn't owe more taxes and probably left refunds on the table. He is now a LPR and has a SSN, so we are wondering:

1. Has anyone converted their ITIN to SSN with the IRS?

2. Has anyone filed back taxes from previous years?

We might need to hire someone, but I thought I'd reach out here first. Thanks in advance!

(1) You'll need to write to the IRS and let them know that he now has a social so his ITIN records can be merged to his new SSN. See http://www.irs.gov/Individuals/Additional-ITIN-Information for the address/documentation.

(2)You can file back taxes for as many years as you want but there is a 3 year statue of limitations on refunds. So any refund due from 2009 has already expired. I believe the statute of limitations on tax owed is 10 years. Personally I'd see a tax professional to help get things squared away. Tax filing makes me nervous lol :)
