G-325A and letter in intent.

OK . IMO, the date on those two documents will not matter.

Since yer filing so close to the official divorce date, I suggest you include a letter of attestation that covers the seperation period on you and yer ex.

her papers? with the exception of the G-325A -

it's YOUR papers that you submit with the I-129F.

A photo copy of the certified copy of the divorce decree.

fast forward to Manila IV document intake, and she has to submit several different forms for HER visa application. One of those will be the certified copy of the divorce decree.

OK - I'll bite - what 'documents of hers' are you waiting on to submit the I-129F petition ?

OK... I'll bite! Read the GUIDES

G-325A and Letter of Intent to Marry are both listed for the beneficiary to complete and date.

Hello everyone. I have a quick question about filing. My ex-wife moved out last year, we weren't in a hurry to file for divorce at the time. After she moved out I met Marife and we got along very well. So I went to the Philippines to stay with her and her family on my birthday. Before I went there I tried filing the divorce papers, but incomplete info kept getting it kicked back. Anyway, we wanted to get all of our papers ready to go so we could send them out after the divorce decree was issued. The decree should have been issued around the 22nd of June. We thought we'd be safe and put June 30th on Marife's and my papers. So she could mail them to me ahead of time and I can get everything ready. But due to whatever reason the court didn't get to finalizing things until today, July 1st. I am wondering, should I have my fiance fill out new papers with a date later than the the 30th or if that one day is going to make a big difference.

Thanks in advance for the advice.

I agree with the other "good advice" you received, take the worry out of being close, get new ones with current dates.

Oh... pop down to the Philippine forum and say "Hi"

Also update your profile and complete your timeline timeline.gif ... makes life easier here on VJ when answering questions.

Thanks everyone. I just had her make new ones and she is sending them again. I don't want to take any chances.

And thanks Darnell, I was thinking about doing that too. But wasn't sure if I should or not. My wife left me with our two kids nearly a year ago. The only reason I'm just now getting the decree is because we filed for divorce ourselves and it kept getitng kicked back. If they had accepted it initially, I would've been divorced 3 months ago. They make it hard on you if you don't have lawyers involved.

ya, i think that letter of attestation would be useful.

sure, yer filing the I-129F now that you are legally 'free to marry' but IMO, with such a short difference in time, a letter of attestation is useful - as the Vice-Consul would see that prior to the interview date.

You are new, and I believe your question was not answered here and it looks like you never made your own post about it. If you do not know how, on the main K-1 forum page, there is a blue button on the upper right that says "Start New Topic".Click that to make a new post and ask questions.

All that being said, If your state does not have a waiting period that is longer than a month, then you are fine for the I-129F petition. You both need to be free to marry when the petition is filed. Have plenty of relationship evidence for the interview and be able to answer any questions that may be asked about the separation and divorce being so close to you filing.
