Conditional green card status

Timeline

My husband and I are filing the I-130 in a few weeks. We have been married over a year. When they approve the I-130 and the rest of the paperwork and they give me a grren card. When does the permanent residence start, the day they approve it or the day I cross the border into the united states? The reason I'm asking is because if it's when I actually cross the border on my visa, and I cross before next May with my visa(once granted) they will grant me conditional, but if I wait til after May, we will have been married 2 years and I will just be granted a regular green card. i'm trying to figure this out so that we don't have to do any more paperwork or put out any more money than is absolutely needed. Timeline

When you enter to "activate" your status. Make sure to tell them that you've been married more than 2 years when you enter. If you get a 2 year card send it back with an I-90 (no fee) for a 10 year card.

The don't "give you a greencard" until after you've entered the US. They're giving you a spousal visa, once you enter the US on that visa you activate it, granting you LPR status. until you enter, it's just a visa.

At the POE....if married less than 2 years you will be granted a CR-1....if married more than 2 years you will be granted an IR-1. If the visa is approved while still under the 2 years, and then the POE is after May, they will adjust the the CR-1 to an IR-1.

So to be clear, as long as I wait to ENTER the USA until after May 2014 I will be granted an IR-1. Thank you.

But I do have another question. Let's say they approve the visa in January, but I don't plan on moving to the USA until June, will I still be able to go for a visit before June and not use the visa yet????

Depends... The visa is in your passport and most often they will make you POE at that point.

Been out of the US for 3 years so I don't know whats going on with the border of US-Canada. Do you need a passport to go back and forth? As a US citizen I never needed one to go north. Maybe I would need one now?

You need one now. The US government has implemented the Western Hemisphere Travel Initiative which requires all US citizens to have either a passport or one of the other selected documents such as an approved 'smart' Driver's License (micro chip imbedded) or passport card. While they can't keep you out of the US after a visit to Canada, they can certainly give you a really, really, really hard time at the border. Canada doesn't require it but suggests its a good idea. They just need proof of US citizenship.

ID required is definitely a passport, unless you want to get chewed out by a border agent. Birth certificate and photo ID, like driver's license, won't cut it without an appropriately penitential look, as my husband found out when he forgot his passport. They fortunately didn't pull the car over or stick him in the added security line, probably because we were going shopping in Windsor, and I had more documents than a lawyer ready just in case.

If you live in one of the select number of border states, like Michigan and Washington, you can apply for an enhanced driver's license which will allow you through without the passport only at land crossings. It won't help if you intend to fly. Applying for the EDL is straightforward and takes 4-6 weeks to arrive in most states, though my husband received his in 10 days or so. These can be supplemented by a NEXUS pass, which allows the bearer to use an expedited lane through the land crossing and kiosks at select airports in the US and Canada. Basically frequent traveler passes, they're good for 5 years and a great investment of $50. I'm applying for mine on my next paycheque now that I have everything together. :)

The passport is really your best bet though.
