i had a similar question... overwhelming VJ members recommended against this!

here's the thread:

http://www.visajourney.com/forums/topic/432499-k1-filed-can-we-do-a-wedding-ceramony-and-not-register-it/#entry6252717

Very bad idea.

If the couple wants/needs/requires a wedding in country of fiance/ee, then they should go for a CR-1

Posted

Seems there are plenty of people in this thread who don't know how the K1 works. I suggest not giving anyone advice if that's the case.

Then they have done something illegal. Stop suggesting other people do the same.

Second this.

The couple mentioned here is in a boatload of problems and they don't even realize that! (or maybe they do and seem to think immigration laws are not to be taken seriously); in either case, they have crossed the line and if what they've done is found, they will face serious consequences

Posted

Thanks all for your responses. I have already told her about K1 and the need to marry in the US and not her country. She is blaming it on her brothers (she is from a village) and how they won't let her go alone. I told her that it's impossible for me to go to her country even for one week. She simply ended the relationship and said good luck in your life. We fought a lot before this but she would always go nutts and call me 100 times a day until we get back together. Now after she got the visa it seems it's the opposite.

At this point, I have made up my mind and I don't want her anymore. My main concern is that she would use the visa to come to the USA and live with her sister illegally. If I tell the embassy there, would they call her back and revoke the visa??

You complied with your part by informaing USCIS/DOS that the marriage is off and requesting voiding visa; you can also contact embassy and do same. Whatever they do or not is up to them.

i think its not about scam,i thought you should let her know the consequency of been there amd married, however i sugest you ask her to come over or you will ask USCIS to cancel her visa being plain and say the fact...sometimes some people go insane about there culture this is not about that its about the rules of engagement in USCIS...bE BLUNT AND SAY U WILL CANCEL HER VISA IF SHE TURNS TO BE A SCAM!

Posted (edited)

I agree - if this is a scam it's one of the worst thought-out scams ever. Perhaps she is getting pressure from family to have a ceremony before she leaves - without understanding the potential implications on her admissability into the US. I personally wouldn't conduct a non-legal ceremony - too much risk.

My wife and I discussed both routes (K-1 vs CR-1). It was important to her family in VN that she have a traditional wedding so we went that route, even knowing it would delay her entry into the US. Don't undersestimate the influence of family in Asian culture.

It seems that you didn´t start on the right foot.... Things happen for a reason, and maybe this disagreement you had in the last step was the straw that broke the camel's back. If she was so radical and made the decision of not wanting to hear from you anymore, that explains much about her sense of commitment with your relationship.

Like other VJ member said, "You complied with your part by informing USCIS/DOS that the marriage is off and requesting voiding visa; you can also contact embassy and do same. Whatever they do or not is up to them".

Could it be sister have enlightened her to get

married there now, don't disclose (fraud) but as

a wife she'd be here already, can divorce U & now

able to fight for a GC, as the K1 would not allow

her any other immigration benefits ever if not

married in 90 days....don't know just wondering

as some ppl are very good at scamming but don't think

about the later consequences.

I'd say if there's doubts now is the best time to walk

away....best wishes

I am not sure why some people who go through this process are in such a hurry to view these situations as a scam. Scams do happen, for sure. But it doesn't mean it's happening to you. You loved her.. you trusted her enough to begin the process. I don't feel your fiancee being "easily agitated" means she wants you only for papers. Love takes time.. love requires patience! Especially when you're from two different cultures. Maybe she's beginning to feel nervous about how things are going to change for her. There are lots of scenarios. Give her the benefit of the doubt. If she is coming just for paperwork, you will find out in time. Don't love based on conditions.. love freely and hope you will receive the same in return. That is what life is my friend. You can never ever truly know what's in someones heart. You just have to do your side and God willing your efforts will reap the joy you undoubtedly deserve. Good luck!!!!

aurlian she got the visa she wanted, probably she will come to the US and live illegally for the rest of her life. Some people don't care if they will have papers or not here they just want to get here, no matter what.Call the Us Embassy in China they may revoke her visa.

You really need to talk. maybe talk to her sister. What I suspect is someone is filling your fiancee's ear with suspicion and things.

Like hearing and reading stories of USC's who abandoned the foreigner and don't marry them and they are stuck.

You need to ease her mind. Do you guys have a date you plan to get married or have you wavered on the dates and maybe she thinks you have cold feet.

I sure in the world wouldn't scream scam unless you invested a bunch of money and now she puts the breaks on. (I have seen that done also).

I would not make a move until you have at least talked to her and you both decide what is the next move.

The biggest scam of your life because she wants a wedding with her family ? LOL....that is not a scam, it is a woman who wants to be have a wedding with her family present, perhaps family pressure to have it there.
How do you put scam into that equation ?
If she wanted to scam you, she would not even care to go through a wedding there but have a court wedding here and be gone after AOS.
Why would she want to embarrass herself in her own country with a wedding if she plans on leaving you ?
I am sorry but from the info you have given here you are way off base.
You need to educate her on how a K1 works and give her some links to read.

Have a ceremony celebration there with her family after she can travel.

Chillax !

if you decide to stay with her -

you can host a wedding party, not registered with the governement, and still have her come here on k1 visa.

if you decide not to stay with her -

just write to embassy and immigration to null her visa

imo, you are not fit to marry her at all ! you did not take your time to understand the chinese customs. it just seems like both are incompatible in the long term.

if you really love her, go live in china for a year and learn about chinese customs! not just using chopsticks and eating chinese takeouts.

Maybe 30 posts ago a few others still giving scam opinions missed this....?
