I-134: submit in DUPLICATE means two copies or what?

Current income is what they care about the most. What you made in the past is not what they base the requirement on. You can use the assets at 5 times to make up for a shortcoming in your income. For example, if you make $14k and need $19k, then you are short $5k. You would need the bare minimum of $25k in assets ($5k times 5). Provide proof of ownership of the assets and proof of value.

Hmm, if this is so then what do the people who are currently unemployed do then? I would think they would have to also consider the past as well, actually I read that they view up to the last 3 years. Furthermore, how can they go by CURRENT income when the latest tax reports they can even see is LAST YEARS, 2012.... It would make sense to think that there would be an equal weight upon current income as well as the past 3 years, because one could be unemployed/struggling now (my present situation) but was much more financially stable last year, or 2011 or 2010.

If you are unemployed, then your income is zero and you do not qualify to sponsor. If you had enough in assets at 5 times what is needed for income, then you could still sponsor even if unemployed. It is not based on the past income. Current income is proven with a letter from employer and recent pay stubs. For example, if you earn $10 an hour and work 40 hours a week, then your current annual income would be $10 x 40 = $400 weekly and then $400 x 52 weeks in a year = $20,800. Current annual income is what is listed on the form where it asks for your annual income. If you are unemployed, you do not put last year's income. You put $0 because you are currently unemployed and that is in fact your CURRENT income.

Only the most recent tax transcript is required. You can provide more years if you think it will help prove your current, stable ongoing income. For other consulates, no tax transcripts are required at all with the I-134.

A lot of consulates accept co-sponsors when the USC petitioner cannot meet the requirement to sponsor. There are others that do not. Manila is very strict about co-sponsors and seem more willing to accept one when it is a family member and that family member supplies an I-864 instead of an I-134. The I-864 is a binding contract, and the I-134 is not. AGAIN, I have NO experience dealing with the embassy in Manila. You need to ask in the Philippines regional forum so people that DO have experience with Manila can help you better.

Jay-Kay: I dont quite understand why you are stressing so much about CURRENT INCOME... I've read the instructions myself and many other threads about the I-134, and nowhere did anyone make such a big deal as you are making concerning the CURRENT income You are making it seem that if someone doesn't CURRENTLY make the $19K needed for 2 people (in one year for crying out loud) then they will be denied but I think you are wrong. For example, this is verbatim the 1st paragraph on the instructions for the I-134:

Supporting Evidence

"As the sponsor, you must show you have sufficient income or financial resources to assure that the alien you are sponsoring will not become a public charge in the United States

Failure to provide evidence of sufficient income or financial resources may result in the denial of the alien's application for a visa or his or her removal from the United States"

NO WHERE DOES IT STATE that the income must be CURRENT so quit stressing so much about that!!!

Yes, you are right. I have no experience with this process and have not helped others through it either. /end sarcasm(for now)

If you know the answers, then why do you keep asking me?! I am not stressed about it. I am already done with providing the affidavits of support and never have to worry about them again. Perhaps Manila allows those that are unemployed to be approved and you will slip through. Good luck with the I-864 for AOS. They will not let you slide while earning nothing at all to support your spouse. I guess you can rest at ease knowing they will allow a joint sponsor with the I-864 for AOS though.

I have been trying to help YOU, but you obviously know all the answers already and so I shall not bother with your rude self again.

The embassy in Manila in their Instructions letter dictates that they want the most recent tax return & W-2, which for this year would be the 2012 Tax return. They do not ask for 3 years of tax returns and they don't do any "averaging", the embassy wants to know what you make NOW. If you make nothing then you have a problem unless you have assets equal to 5 times the shortage per the I-864P Poverty Guidelines, or you are able to get the embassy to accept a co-sponsor.

Now regarding the I-134 item #7 first financial line wants to know the annual income you derive (Exact wording is - I derive an annual income of:), so if someone asks you what is your annual income do you toss out some number from years ago or do you think they might want to know what is your CURRENT annual income?

No one here wants to sit and banter wording with you... we are all here trying to help one another the best we can from experience gathered. If you don't want to listen to what is said and head to the embassy with NO income, NO assets and NO co-sponsor.... that is up to you, but when you get denied the CO will not be interested in your word games.

You say you already know all the answers. You are just arguing to argue and not actually wanting help. If you had actually researched the matter as you said you did, then there is no way you could conclude that I am the only one that lets people know they need current income.

Someone that is unemployed and has no income does not have 'sufficient income'(to quote the I-134 instructions you seem to like so much). Nowhere in those instructions does it state to take an average of your last 3 years of income either. If you are unemployed and not earning income from any other source, the answer to #7 of the I-134 is that you are unemployed and the annual income you are deriving is $0. If you want to state something else and misrepresent yourself, then that is your doing but no one should advise you to do so.

When you need the I-864, it does spell it out in simpler terms right on the form, "current individual annual income".

Again, you are not looking for help, so do as you wish.

It's been said here before: One's success in the immigration process depends on the ability to read accurately, interpret literally, and answer completely and honestly. A kindly meant hint: More study and less asking will reveal even more thorough and reliable answers than you'll get purely by asking. Other members shouldn't have to reinvent the wheel for you when most information is already there for you to locate and absorb. If you've searched and read all the available material but still have questions, then come to the forums and ask.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
