Haven't been here in forever. My wife is the reason that brought me here in the first place. Happily her mother is here now and we are working on her brother now.

That being said, here is my question.

My brother in law wishes to get a tourist visa to visit his sister (my wife) and his mother (my mother-in-law). At this time, my wife and MIL both have immigration proceedings to bring him here with an immigrant visa. Does having an immigrant visa in the process doom the tourist visa request or make it more likely?

Note:

Reasons to return

1. Owns an apartment there

2. Has a girlfriend

3. Girlfriend is pregnant with his child

4. Has a good job at a bank

Just mentioned those factors are reasons he would be returning. Further note: He won't be approved for immigrant visa to come to the US for another 6 years.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

He is only coming for a visit to the US to visit family hence the tourist visa. Then he will return home and wait until it is the proper time to come here with the immigrant visa. One visa at a time. :)

We tried this when our I-130 application was pending and the tourist visa was denied because of the pending application. Not saying that is always the case but I think it's a long shot.

Chances are good, but your brother-in-law should bring pictures, pay stubs as evidence to support his case. Remember the conuslate doesn't really care much about why you want to visit the US, they want reasons and proof that he will leave again.

It's amazing how many questions can be resolved with a 2 minute Google search...
