The I-751 was revised for April 2013 and most of the information out there regarding this form is legacy.

I'm a bit confused as it seems in the past this section was used to merge the applications of children into the spouse's. For this revision there still appears to be verbiage that touches on this in the instructions (regarding A numbers, etc).

Our child is a US citizen. I'm guessing he should he be listed here as well, but I don't want to assume too much with these folks.

Also - Part 5. Are we to checkbox the trio of "NO" boxes if no request is being made under this section at all?

04.26.2010 | Day 0 :: Lockbox received I-130 packet w/ consular processing in Perú

04.30.2010 | Day 4 :: $355 check cashed, NOA1

10.05.2010 | Day 163 :: I-130 NOA2 California approval (5 months, 5 days since NOA1)

You only include the children that are also getting their condition being removed along with you - kind of joint application possible only if the child entered US within 90 days of the immigrant parent.

In your case you should not include your citizen child.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

This has been a confusing issue for years and highly debated. Some people listed their USC children and others did not. We did not use the new form when we filed, but I included my USC children and just made it very clear they have no A# and are US citizens. My husband is the one removing conditions, but they are his step kids and some of our evidence included them as well.

If the child is yours together, then I believe you should definitely list him/her. It states to list ALL children of the person filing for ROC.

It states to list ALL children of the person filing for ROC.

I'm inclinded to agree with this prespective based on the wording of the header --

My wife and I have four children. Two are from her first marriage and two are ours. Our two were born outside the US.

As my wife is the USC our two children derived Citizenship from their mother which we sorted out at the consulate abroad.

They entered the US as US citizens on US passports.

My understanding of the I751 instructions were that if your children are US citizens they DO NOT have to put on the form. So I left that part blank.

Now you got me confused. I am getting ready to file I-751 towards the end of this months. I have one child, born here in the US. I assumed that I'm supposed to put him on the form, it says "all your children"... Then where it says "applying with you?" I put "No" and A# I put N/A. Also I'll include his birth certificate with our evidence. I think that makes it clear that he's a USC, and he's not removing conditions only I am.

I had a quick look at the I751 and the filing instructions. It is different to the form I filed at the beginning of this year.

This new form does appear to be more specific, "List all Children".

So what did you do? And what happened as a result? I am in the same position.

I ended up placing our son in the section. I ended up taking the header literally, regardless of citizenship.

Thus far the paperwork was received and extension granted, but no futher updates on processing since.

In your case you should not include your citizen child.

Wrong.

List ALL your children means exactly that. All of them.

In case of a USC child, you list them, then put YES to "living with you?" and NO to "applying with you?"
