JAN 2000
: My husband entered the usa with visitor visa B1/B2.

JUN 2000
: He over stayed his visa.

APR 2003
: After September 11 immigration called for registration for all

illegal people in the USA so he went to the immigration and did

the registration.

JUN 2003
: He received an immigration court hearing letter.

Sept 2003
: His lawyer told him that voluntary departure was the only option

Sept 2003
: He was granted voluntary departure by an immigration judge

However he did not leave

JAN 2004
: My future husband and I met

MAR 2005
: We married and have been married for 8 years now,

He is my only family, other than my elderly Mother,

We have no children, I am a us citizen

DEC 2012
: He left for family matters to his country (his Mother passed

way and his Father very sick).

Mar 2013
: How can I bring him back home ?

I would greatly appreciate your advice and also opinion

Correct me if I'm wrong, but I believe he is facing a 10 year ban, so he wouldn't be eligible to return to the US until 2022.

Was unlawfully present in the US for more than 365 days after April 1, 1997.

INA 212(a)(9)(B)(ii) - 10 yr ban, immediate I-601 waiver eligibility with a qualifying USC/LPR relative. NOTE: Time spent unlawfully in the US while under the age of 18 DOES NOT count towards the 365 days in this specific section of the law.

You need to file for an IR1 visa. He will go through the process and the interview and will be denied because of the ban. Then you will file a waiver which will hopefully be approved.

As mentioned above, you need to petition him for an IR-1 spousal visa and go through the same processs everyone else is. He will be denied at interview and then you file the waiver for the ten year ban. He wil likely have another ban for ignoring the voluntary departure.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
