Need Help: Second Interview!!!

Hi everybody!

I just received a second interview notice for the NY office after our first interview. Please, if you have any ideas or advice, that would be very helpful.

The main question: shall we hire an attorney? from what I read, it doesn't guarantee good outcome. For example I found this document - USCIS's worksheet on red flags - an attorney can be a problem.

You haven't given any information about your case, so it is difficult for anyone to assist you with answers. If we know of any red flags on your case (anything that would cause the officer to doubt the validity of your marriage), we can give advice on what proof to bring to overcome them. I don't think anyone can really help you without more details.

Hello!

I am not sure, what was the specific reason. She asked regular questions, we both replied normally. Few issues:

1. When they asked my wife where i work, she said in the bank. She couldn't name it, because she never asked me, it was a temporary job, where i was interning, I never seriously considered in that place for a long time. Now I am working at another place.

2. We have a joint sponsor, since her income is not sufficient. I found the joint sponsor, she's my family friend. I just told the name of the person to my wife. My wife was asked the name of the sponsor, she gave it. She couldn't specify what is the relation of the joint sponsor to me.

3. I was asked whether I have a driver's license, I don't have the one (I don't drive). I had a local picture ID, I guess I should have given it to the IO.

All the other questions we absolutely ok. She's a student, working as a babysitter, I am working in finance, graduated 2 years ago.

We married in June 2012, we are living together, have a joint bank account & we are enjoying life together.

I can understand why you are getting a second interview.

The driver's license is not a problem.

However, the first two things are pretty major and would ordinarily be extremely common things that a husband and wife would know about one another.

I'm an MBA student, and my husband has been with me every step of the way with the internship search, and you can bet he knows every detail about the position I took. I find this bit confusing.

My husband and I are both students and we needed a joint sponsor, also. But, that sponsor is a very strong mutual friend. I cannot imagine a stranger to one of us being willing to sponsor. And, if I was your wife I'd certainly be wanting what random woman was willing to put herself on the line for my husband.

Finance is often a high paying profession. The IO thinks that you are paying your wife, a babysitter who probably doesn't make much, in exchange for a sham marriage and a green card.

Don't take my comments personally. I'm letting you know how your case looks to outsiders.

Thank you for your answers.

Well, every couple is different. My wife is an art person, way far from numbers, analytics & finance. I just told her that i got an internship on the wall street, in a broker firm, just for experience, that's all.

As for the, sponsor, I agree, I should have told my wife more about her.

I am not paid much even now, although I am working in finance. It's a tough situation in this sector right now..

Now perhaps you have a better idea of the view of someone outside looking in. For your second interview, you will be separated and interviewed individually. They will then compare your answers to see if they match. They will be general knowledge questions that every married couple knows about one another, like questions about your house and your schedule and your past. I'm not sure if a lawyer can help with that.

It is hard to give any meaningful advice when you don;t say the country or the basic facts about the case. People asked you after your first interview and you seemed to deflect there too.

I recommend you to take a lawyer with you, it's worth it. the second interview will be tougher, most likely they goanna separate you and ask a lot of questions , and then compare the answers. your wife is look a like my wife, she doesn't give attention to a lot of stuff, and I remember I had argument with her about the process, the way she thinks that as long as we love each other the GC will come in the mail, that's not the case at least in USCIS eyes.. I understand people have different personalities. But, I am advising you, you need to make your wife know all the details. Take it serious, NY office is well known of their Stock interviews, so don't mess around at this point, they called for a second interview, it means they suspect a fraud. Be very prepared and take a lawyer.

an experience immigration attorney and am sure u might be seperated for the second interview, nothing to worry about just practice plenty sample questions together.

You're getting a stokes interview. You should consider a lawyer. Be prepared and good luck!
