My understanding is that if you have an approved I130 at the embassy, they will just ignore the K3 b/c it is a lesser petition.

I would say to continue w/the CR/IR since your case is almost completed. If you decided to continue w/the K3 what happens to all that money to paid in fees? Would your SO just go back to the Consulate for their interview or would you do the AOS once they arrive in the states?

It is possible that K3 would reach the embassy first, so if you have the money to pursue both, you can do that, but it might add up to a very little gain in time, or the IR/CR1 might get there and just cancel the K3.

I guess it depends on how quick you want your spouse to be here with you. Usually CR1 takes much longer at NVC than K3.

Going by your timeline, both the I-130/CR-1 application and the I-129F will be at the consulate fairly close together so I wouldn't be worrying about anything. As has been stated, the approved I-130 & CR-1 application once at the embassy/consulate will override the I-129F and any application for the K-3.

Thanks for all your replies ....

** Aussie wench -- I have seen a lot of replies from you in this forum. and personally feel your replies very informative.

Hopefully my CR1 goes fast. what if the k-3 reached embassy first and then CR1 after some time. Then what do I do?

1. Do my wife show up at embassy for k-3 interview and tell them we are expecting CR1 shortly. OR

2. Get the k-3visa and wait for CR1 interview without travelling to USA.

** All I want is to avoid the AOS process delay if she accepts k-3 and comes to USA ( I am Ok with my wife to wait a little longer in the home country and get this immigration stuff done once for all).

There are a few options if the I-129F reaches the consulate first.

1. As you say you can inform the consulate that you are wanting to interview for the CR-1...or

2. You can stall for the K-3 via the packets to allow the approved I-130 and immigrant visa application to catch up.

3. Continue with the packets for the K-3 once the I-129F is at the consulate and you may be able to switch the K-3 interview date for the CR-1 once it has arrived at the consulate. You would need to check with the consulate if this is possible beforehand as not all consulates will just replace one with the other. Instead, some cancel the date for the K-3 and reschedule for the CR-1...

I dont see the point in doing the K-3 and then waiting for the CR-1 without activating the visa, as for one I am pretty sure you will need a new police certificate. I'm not sure on the medical if that can be used again but someone else may know if you are able to do so.
