I sent my packet on 4/5 and it was received on 8th. My check is still not cashed out. I did not receive NOA.

The first thing I do when I get up in the morning is checking my checking account. Hopefully I will hear back from them pretty soon..

Your lawyer's information is not correct. I suspect he works mostly with cases that have red flags, and yes, cases with red flags ARE usually asked to go in for an interview, thus the percentage he gave.

The truth is that interviews at ROC stage are quite rare and are usually reserved either for cases with red flags or those with very weak supporting documentation. Sometimes they do conduct random interviews in what look like straightforward cases, but this isn't the norm. Most cases either get a straight approval or an approval after an RFE. On rare occasions, if the evidence submitted with the RFE is still deemed unsatisfactory, then an interview could be requested. Again, this is rare.

USCIS Officers adjudicating ROC are specifically instructed to avoid interviews if they can, since they don't want to pull too many resources away from other petitions where interviews are obligatory.

If you take a look at the threads from previous months' ROC filers, you will notice that interviews are not common at all and have mainly happened in cases where there was a divorce waiver, or a change of status mid-process, or similar.

Thank you for your knowledge and explaination. He was a pretty new immigrant lawyer. I filed my paper without a lawyer and I felt good about the evidences I sent, so hopefully everything is going to be a smooth process.

A quick glance around various forums here shows that CSC has apparently taken a coffee break - not just for us ROC'ers, but K1, too... hopefully it's not an extended one.

Also, while they might count from the day they receive the application, it's still better to have legal documentation of your status in the US. 99.9% of officials will jump first and ask questions later. If you're stopped for whatever reason, and you can't prove your status right away, it will cause you a whole lot of unnecessary issues, time, and stress for everyone involved. Always front load, always have documentation, and always be safe rather than sorry. Make an infopass appointment as close to the date as you can, and get that stamp, because we have NO CLUE how long this coffee break at CSC will last, and I'd hate for there to be any problems. You might not have been asked for it in the past, but that doesn't mean it can't (or won't) happen. Like I stated previously: SAFE rather than SORRY. :)

Agree with frenzyheart about CSC. And I'm sure they'll clear all the backlog in 1-2 days (they've done that before), but we don't know when that will be.

There seem to be some slow moving ROC approvals in Aug '12 and Sep '12 filers, but that's about it. Most approvals for both those months had happened before the slow down anyway.

I also agree about the need to have proof of your legal status, but that's an individual call.

Jill84: I have never booked an InfoPass myself, but I imagine it would be the first option(???)

For my husband's, I just did #3. It will take you to a page that says "We'd rather you use our website" blah blah blah... but down below that, it will say something along the lines of "If you still need an appointment, click here", and then it will take you through the appointment set up. Once you've got it set up, just print out the confirmation page (you HAVE to have it) and make sure you take your passport and photo ID with you. :) We were in and out in less than 20 minutes. (Times may vary; we're from Des Moines... very small. LOL.)

Just grab an appointment for the closest date you can. If your card expires before that, you can try and go in without an appointment, and maybe they will see you on an emergency basis. Don't hold me to that, because I really don't know, but if you're close enough to the office, it's worth a shot. Better they know you're trying to make sure everything is on the level than for another source to request your now expired card, and thus have all that hassle... you know what I"m saying???
