Hi, i need advise on this matter so I can relay to my cousin. She came here 2 yrs ago on a tourist visa and at her US port of entry, she was asked to go back to Philippines. she was found out to have overstayed on her last stay here in the US. I think she got a 5 yrs ban. Her daughter who just became a citizen wishes to petition her mom before the 5 Yrs ban. Is it possible ? And can anyone advise what are the steps? Hope to hear from you guys. Thank you.

Does she have a qualifying relative for the hardship waiver because a child doesn't qualify to file one for their parent. Otherwise she must wait out the ban. 5 years is an odd amount. If the overstay was less than one year it is 3 years over a year it is a 10 year ban.

This will not be over quickly. You will not enjoy this.

Hi, yhe daughter is 32 yrs old and she is here in US while the mom is in Philippines.

What do you mean by relative for the hardship waiver? She has relatives in the US. So what can she do?

I believe denial of entry can be a 5 year ban, same with deportation. i found a list once but now I can't find it... really though I'd saved the link :S

Found it!! http://shusterman.com/pdf/detention1004.pdf (page 28 of entire document, numbered page 26)
