Hi,

In from Canada and my boyfriend lives in Kentucky. We are in the process of starting the K1. We just found out about my sponsor needing to make 125% of the poverty guidelines. My boyfriend does not make enough as he is on disability and only makes 14K. Even with adding his assets i dont think he will make poverty level. I make good money here in Canada, would i be able to prove that i can support myself or if i have money in my bank can that be included?

No you will not be able to use your assets from Canada. You will need get a co-sponsor.

You cannot use income, as you'll need to leave your job when you immigrate to the USA, presumably.

Are you set on doing a K1 fiance visa?

Adding your assets to his is possible for a CR-1 spousal visa, though many US embassies require the assets to be US based.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Not set on K1 it just seems to be the fastest route. It seems to me that both k1 and k3 have the poverty guidelines so we may need to get a cosponsor regardless. My boyfriend doesnt have alot if assets just 2 vehicles and a trailer.

Both the K-1 and the CR-1 require financial sponsorship. Ignore the K-3 because it’s costly and isn’t any quicker.

The K-1 isn’t really faster plus you have the disadvantage of not being able to work right away after you move. Without authority to move you cannot be paid Canadian EI. Plus it costs a lot more.

However, the choice is of course up to you and your fiancé to decide. Either way you will most likely need a co-sponsor.

Everything said above is good advice.

I just want to add that embassies don't have to accept co-sponsors on K1 visa. Some do, some don't. Even for an embassy that generally accept co-sponsors for K-1 visa, it happens that they refuse co-sponsor if the income of the primary sponsor (USC fiancé(e)) is too low (http://www.visajourney.com/forums/topic/402790-k1-visa-denied-public-charge-pretty-outraged/). Probably you should check on the canadian forum what is the embassy policy there.

I am no expert on the subject but I think embassies cannot refuse co-sponsors with I-CR1 (please check this carefully because my knowledge on I-CR1 is very poor)

Saving can help, I am in a very similar situation K1 applied bor but the USC is still in college so does not earn above the 125% line. I have around 15000$ in savings plus we are being cosponsered I will let you know our experience we are still waiting for NOA2 at the moment.

Sort of. The I-134 lists 100%, but most embassies want to see 125%, because this is what will berequired at AOS after marriage.

The $15,000 in saving will be treated like $3,000 annually toward your income.
