Adjustment of status taking long

Timeline

My wife filled for an AOS after entering into the country on K-1 Visa.She has applied for adjustment of status and had her biometrics done since November 20th.The case shows it was touched on 14th December. But we have not heard anything till today. The case is now with MSC.

Please does any one has an idea on what is going on or does anyone has dealt with the vermont service center?Please tell me something.This is insane

Oh wow, so sorry about the long wait.

We've filed 1st week of January we already have March 12th interview here in San Diego. Most of us Jan 2013 filers are on the same stage now too

Some K1s are approved w/o interviews and some are transferred to a local office to have interviews. If youre a K1 and your case is still at the NBC (you can tell where you are by checking your case status online or by calling and asking where you are) and you have not been transferred to a local office after many months of sitting at the NBC most likely youre not going to be.

Every K1 goes the NBC. There they send out RFEs, and do 'general processing'. They then do some sort of top secret most likely random computer generated selection on the cases to determine who gets sent to local offices for interviews and who is retained at NBC for approval w/o interviews. Those cases forwarded to local offices are forwarded. Those K1s are sent notices 'your case has been transferred' They receive interview notices from their local offices. Sometimes quickly, sometimes slowly.

Those left behind at the NBC are left behind. The average wait time for those left behind to be approved w/o interview at the NBC seems to around 6 months. Unfortunately there is no posted 'normal processing time' for AOS at the NBC because NBC does not process 485s. This is a recent thing they implemented to 'speed up the process'. So K1s who are left there can not put in service requests to find out whats going on with their cases.

Your only option is to contact your congressperson to ask for an inquiry. An inquiry from a congressperson is basically the same thing as a service request. They will have their liaison 'ping' NBC and get a status update on your case. Contacting the phone center will give you no results. They will simply tell you, your case is at NBC, you have to wait. There is no processing time limits on how long you can sit there- so we cant contact them to ask why you are still there.

(for the OP who applied in Nov 2012- you should join the Nov AOS filers thread. If you havent gotten a transfer to a local office by now, you may not be getting one, and youre prob looking at about 6 mo from when you filed to be approved w/o interview)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

lol no. This all information available in multiple threads throughout the forums.

There are threads about how to contact a conrgressperson and what happens then.

There are threads about what happens when you send in a K1 AOS and how do they decide if your interview waiverable or not. Theres threads for monthly filers where you can watch the process work.

Since Im also a K1 Ive read them all. I just condensed it down into one post for you.

But unless youve been at NBC for a long time w/o interview (over 6 months) its not odd (based on the stats on VJ) so dont panic. If youre past 6 months at NBC then IMO you should contact your congressperson for an inquiry because you have no other way to find out whats going on.

Once youve been transferred to a local field office youre at their mercy. How long you wait at that point is on them. You'll get an interview when a slot opens. Some people wait months, others wait weeks.

People who submitted their K1s before the date of that memo (Aug 2012) wouldve have been sent to CSC and not NBC. They could be caught in the dreaded CSC black hole. If they pass the normal processing time for CSC they can file a service request, but NBC people can not. But nobody is going to CSC anymore. So while theres still active people on here trying to get K1 AOS from CSC, for the most part most people are NBC based.

Again I strongly recommend you join the monthly thread for the month you filed. Youll be able to track your progress with others in the month. When people start getting approved w/o interview they'll post it. You'll know to expect it soon and if not and everybody in the thread has been approved but you, you can consider contacting your rep to inquire.
