Hi looking for some help and no judgements please.

Last week, my husband (US Citizen) got pulled over for speeding. When he opened up his glove compartment there was 1 hydrocodene in his glove compartment which the police officer saw and issued him a ticket for because he has no prescription for this. He got this pill from a friend as he has been having an issue with his back and has been in alot of pain...yes I know stupid mistake and you should never ever take something in which a prescription has not been prescribed. Again no judgement please I feel bad enough and my husband feels really, really stupid and embarrased for doing such an implusive thing. He has no prior convictions or arrests.

We now have to go to court in February.

Long story short is: how will this affect my AOS application. I have never been in trouble with the law and am the beneficiary. My AOS application is currently being processed.

If the AOS application is approved and I am given my GC, what will happen when we file my I751?

Hoping that someone can shed some insight

Sorry to hear this as that is most unfortunate and we all make mistakes. I'm not sure but I do not think that this will affect you in any way. Perhaps someone else can chime in?

Our love began in 2010....our Journey in 2012 (January) and now we are at peace until 2014!

Timeline (kinda-- Im not putting exact dates- just months~)

--January 2012-- Sent our I-485 and I-130 packet off :)

--February 2012-- Touch-- Need more evidence.

--February 2012-- Sent more evidence.

--March 2012-- Biometrics and Doctors App (around the same time)

--June 2012-- (BIG PROBLEM) Immigration sent us a 'DENIAL' letter due to not having a sponsor (I thought we didnt need one)

--June 2012-- we hired a lawyer and got a sponsor, got the I-290B Motion to Appeal or Reopen had everything sent off by the end of July 2012.

--October 2012-- OUR APPEAL WAS APPROVED (breath easy, we didn't have to wait too long)

--October 2012-- Work permit sent-- got SSN

--November 26th, 2012-- AOS interview-- Got sent out told to get a translator and new interview date would be sent. :(

--January 8th, 2013-- Second interview...went well but no idea if we were approved or denied....VERY STRESSFUL!!

--January 15th, 2013-- APPPPPPRRRROOOOVVVEEEED!!!!!! (checked on USCIS web site)

--January 18th, 2013-- Card Production Ordered....welcome letter (hard copy) in the mail!!! :)

--January 24th, 2013--CARD IN HAND!!! DONE!!!!!

It will not affect your case. You don't need to take any paperwork on it, that's only if it was YOU who did it.

I'd be interested to know how the cop knew it was a hydrocodone pill without reading it. Have you had a quick chat with a lawyer about the situation?

That is good to know. Thanks for the response. I could kick my husbands @#$ for being so foolish!!

The cop told my husband to pass it over after he spied it. The appointment with the lawyer is at the beginning of February.

We have (like in Canada I think) ibuprofen + codeine available over the counter. Mum brought some with her when she visited and I'd been having back and tooth pain (I now know I need a root canal) so she left some. I didn't even think about the possibility of being searched :S I kept them on me too in my handbag. Ok... lesson learned!
