My wife i-130 was approved before our i-129f

HMMM.. My wife I-130 form was approved before the I-129F & she now in the states she is in the u.s now visiting me , can i adjust her status & go for the green card one time , when we file she was out the states at the time, we did get married in the states a few months ago & she went back home to work & came up for the Christmas. can i adjust her status or do a CR-1

she have a b1/b2 visa & a u.k passport with a waiver in it


Sept.12 2012- got Married to my best friend(Ms.Keyzz)

Nov.01 2012---- my wife went back home

Nov.08 2012---sent I-130

Nov.13 2012-- I-130 Case accepted and routed to U.SCIS National Benefits Center for processing

Nov.24 2012-Received R.F.E I-30

Nov.26 2012--Sent I-129f

Dec.24 2012--wife came back up for Christmas & new years

2013-01-04---I-130 approved

2013-02-04 ---send a letter to Cancel I-129f (can't remember date )& decided to file I-485

2013-04-15-sent I-485, I-130 approval hard copy and I-765 applications to lock box, Chicago, IL

2013-04-20- came back with a note stating the amount was wrong

2013-04-22- i-485 packet send to lock box, Chicago, IL ( the correct amount this time)

2013-04-25- email saying Case I-485 Case accepted

2013-04-29: Received both I-485 and I-765 NOA's hard copy in the mail and the Biometrics appointment letter

2013-05-21: Biometrics done & stamp on my I-797c

2013-05-31: check case on the USCIS web page & its said (your I-485 status is ready for Testing and Interview schedule ( NO EAD CARD)

2013-06-10-hard copy interview letter was mail( NO EAD CARD)

2013-06-12:case updated from testing & Interview schedule to Testing and Interview ( NO EAD CARD)

2013-06-15-Got hard copy A.O.S Interview letter in hand dancin5hr.gif( NO EAD CARD)

2013-07-10 - got a letter from NVC with a case number ( which we cancel from 04. feb. 2013)

2013-07-17- A.O.S approved on the spot ( less then 20 mins)

2013-07-18- Green Card was send out by usic

If you try to adjust her status now then she has to stay in USA until AOS is approved. And risk denial... Did she come to visit you with her lugguage of all her belongings and documents? The officer in the interview might have a hard time believing she came for a visit with all her lifelong documents.

Yes you can try to adjust status from inside usa. You will probably need to cancel the I-130 or something that you already submitted

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

PLEASE EDIT YOUR TIMELINE IN YOUR PROFILE SO OTHERS CAN LEARN HOW LONG EACH STEP TAKES IN THIS PROCESS

Yes you can try to adjust status from inside usa. You will probably need to cancel the I-130 or something that you already submitted

MY i-130 was approved.. so what should i do then because she be here til April or may and if go with the Cr-1 visa she still be in the u.s

The I-129f path is dead at this point, the I-130 has been approved. You have to wait out the I-130 CR-1 path.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I JUST GOT A I-797, today my I-130 was approved & they send it to (N.V.C IN PORTSMOUTH NH) :cry: :cry: :cry::wacko: :wacko: :wacko: THEY TELLING THAT NCV WILL CONTACT THE PERSON FOR WHOM YOU ARE PETITIONING(beneficiary)WHAT THOSE THIS MEAN

That the NVC/embassy will contact you and the non-USC to fill out forms http://www.visajourney.com/examples/NVC_Process_Flowchart_v1-2.pdf

Then an interview will be scheduled once that is all done and hopefully you'll have a CR1 soon after. :thumbs:

It's a lie, really.

Or a very long wait.

NVC takes about 3 months to contact people.

Many people here at VJ, want speed instead, at NVC,

so they read LingChe's NVC Shortcuts in the wiki, and GET Speed when following the shortcuts.

Suggest you study the links that Caly posted, as they are the exact same links I would have posted. (Yay Caly! You Rock ! )
