When submitting the I-130 petition, I the petitioner need to include a copy of my birth certificate. Does it need to be an original copy or can it be a photocopy?

Are you filing for spouse or fiancee?

If you are filing petition for your fiancee, then you need to file Form I-129F.

If u are applying for I-130 and u are married u should only send a copy of ur birth certificate showing that u are a US citizen or a copy of ur US passeport unexpired...

Oh, I just realized that you are going to get married in 2 weeks.

You can send a photocopy of your birth certificate when you send your I-130 petition. Your spouse's (beneficiary) original birth certificate will be needed during NVC stage.

Your, the USC's, birth certificate only needs to be included if you're using it to prove your citizenship. If you're using a copy of your passport or naturalization certificate then you don't need your birth certificate.

Officially the USCIS does not request the birth certificate from the beneficiary at this stage, however, since the petitions have been transferred to different offices a lot of people have been getting RFEs and even NOIDs for the beneficiary's birth certificate. I sent it in anyway just in case. Everything sent to USCIS can be a copy so you're not losing anything by sending it.

Yes, getting married in two weeks so it will be an I-130 for my soon to be wife. Good to know I can send in a photocopy of my birth certificate. Makes it easier than having to obtain another original.

When you say my spouse will need her birth certificate during NVC stage, is that when she starts dealing with the consulate abroad (Japan)? Or do I have to send it to the NVC first?

Yes, you will send it in NVC stage. Civil documents like original birth certificate, police clearance, two (2) 2x2 pictures etc...

They do technically speaking. The embassy will send the packet with the checklist to the beneficiary.

NVC will require you to send DS-230 package, that package will include documents that your wife will send to you. You (as the agent) will be the one to forward the completed DS-230 package(documents).

Ok... Should I then have my wife send me her birth cert, police certs, etc. before NVC stage? Sorry for sounding stupid, but it seems like I'm finding something new each day.

I sent the I130 petition in Sept 2012. I just got a request for evidence last week asking for my husband's (the beneficiary) birth certificate. I am not the only one this has happened to recently. I would get your spouse's birth certificate and have it translated and send a copy of each with your petition. This could help avoid an RFE like I got.

When ppl get to NVC stage they should make sure the beneficiary have all orifinal docs BC, marriage cert, divorce dcrees

etc also one set of oriuginals for NVC they are requesting these original and police records , and it maybe mislaid by it get

to intrview date so have two originals copies ready.

Wait until your petition is approved.

No body here waits until the petition is approved and then starts working on gathering the documents for NVC. Not if you're interested in getting through this process sometime in 2013. I'm working on the AOS packet and IV packet (DS-230) right now and I just sent in the I-130. If you have all the paperwork ready you'll be able to fly through NVC and it won't take you 3+ months to get a case complete. The only thing to make sure of is the police certificate as some of those have an expiration date. You don't want to request one too early and then not be able to use it when you need it.
