Hi, I just Filed a K1 and it was recieved by vermont on November 15th and I got my NOA I-797C receipt number but when I call they have record of the receipt number but no information as far as processing yet.

Does anyone know what I can expect as far as them getting back to me?

When can I expect a call or follow up letter with what we need to do next?

How long can I expect this whole process to take from begining to end?

My girl lives in Moldova will they contact her for the interview by phone or by mail?

What should she have prepared for before the interview?

I currently do not have a lawyer, should I get one to make the process go by faster, or is it a waste of money?

Please read the Guide related to the K1 Process. I don't think they will call you. You still have a long way to go and the following is what to expect:

-Keep on checking your case status on line (you just have to provide the case number on your NOA1

-Depending on how busy Vermont is, You should expect the NOA2 five to 6 months from now. However, USCIS may come back to request some more evidence (what we call RFE)

-Then, Once approved wait for a week or two to call the State Department to their case number. At this point your case is ready to be forwarded in the country where your Girl lives.

-Once the US Embassy in that country receives the application, they will contact your fiancee to schedule the Packet 3 remittance.

-The remaining part of the process can be found on this site.

Hopefully no contact until NOA2 receipt. Expect to wait 5 plus months for that.

When can I expect a call or follow up letter with what we need to do next?

Follow the Guides and do your homework on what to do next. You need to educate yourself, they won't automatically do it for you.

9-12 months total.

Mail. Read up on the their Embassy website.

What should she have prepared for before the interview?

Read the Stickies at the top of this forum, Follow the Guides and Example Forms, search back through these forums for similar threads.

Only thing that they will and can make go faster is the removal of money from your pocket.

Can someone tell me if there is a higher chance that my fiance will be approved for the travel visa now that I have filed for the fiance visa? Of course it would be nice if she can come here before 7 months for a visit, but is it even worth her trying to ge tthe travel visa? She was denied it 10 months ago. Of course we have seen each other in another country but I would like her to be able to come here if possible.

My thinking is that since I filed for the fiance visa they should know she will come back to her country to finish the process.

Please tell me your thoughts... :)

Your thinking is quite off, I'm afraid.

Now that you got the K1 ball rolling, it's clear she intends to immigrate; which is exactly the reason why visitor visas are denied.

If she's been denied before, she'll probably be denied again. She's welcome to try and apply. A denial on a B1/B2 shouldn't have any effect on a K1 (unless it was for other reasons other than intent to immigrate/not strong ties to her country). The application fee will not be refunded, though.

Not a chance. You go visit her......with the petition she is now a bigger immigrant risk.

Denied for same a few months ago....nothing has changed and with the petition, that doesn't change anything except make her intent to immigrate more pronounced. Sr, you gotta wait, like many of us did.

I, too, just filed the application in November. I received notice that it has been accepted and was also told I could check status online, with no luck in doing that. I have called on 2 different occasions and both times it was confirmed application is in process. When I asked why I could not view status updates online, I was told by superior that it is taking them between 30-45 days to have information available online.

It is generally taking Vermont, between 5-6 months to process then it will be sent to NVC, and from there it will move to your country embassy.

Unless there are factors (such as criminal records, deportation or things of that nature) then you will be able to process this alone without a lawyer. That is what most of us here, are doing. It isn't complicated, when you read the information available on this site. We are all here to support one another, to seek answers and/or give advice. Plus there are many tools, listed above that can be used, to help understand the process as well. From a few of my friend's point of view, they thought hiring a lawyer is actually a waste of money. Being lawyers are human too, can and do make mistakes. For most lawyers, it is just a job and you are only a file and check for them, but to you it is your life. So, I think if you follow the guides well and ask your questions, you will have just as good of a chance of being successful.

No, I would not think your fiance will have a better chance of getting a travel visa. More so being, fiance now is showing strong ties to you, and they may view it as fiance only trying whichever visa to come and stay with you and not return. It would be best, to continue waiting the process out. I feel it would only complicate matters, cost more money, and ultimately be denied (especially being there is prior denial within 10 month period).

Expect to wait forever..... VERMONT is sooooo slowwwww

My NOA1 was June 5th. I'm still waiting..........

Agreed. I'm June 4th K1 Visa at VSC. No RFE... No updates since NOA1. I've called the service center and they can't help me. They say just to keep waiting. So I would not assume approval within 6 months... Maybe yes or maybe not...

I guess I think differently and don't understand why they would believe someone that has filed for a K1 Visa would be a bigger risk not to come back from a visit to thier fiancee. For I would think those individuals are more likely to return to finish the process of the medical/interview so they may come to the US to be with thier loved one long term. But that is my way of thinking.
