We have a 2 year old daughter together and I am wondering if this would be a good or bad thing since I've heard a few stories where couples having children, and couples who have been married a long time, appeared to be scrutinized more than those who didn't. My friends tell me everything is going to go smoothly because we have a child together but if that is true, why do other people with children and those married for as long as 4-8 years still end up in AP?

My friends tell me everything is going to go smoothly because we have a child together but if that is true, why do other people with children and those married for as long as 4-8 years still end up in AP?

Having a child together has little to no bearing on the outcome of your case. Having proof of an ongoing and legitimate relationship/marriage and showing that you will not become a financial burden to the US taxpayers is what really matters. According to your timeline, there is a two year gap between your marriage and your filing the I-130. You will want to make sure that you have proof of a bonafide relationship during this time. Doesn't really matter. In my case, we had NO child nor we went to honeymoon and we had very few pics together since i stayed only a week after getting married. The outcome was my wife got her VISA rightaway. As long all paperwork is submitted in a professional manner and interview goes well you're on the right track

Women who have children with a USC are refused visas everyday.

Two people could be married, have a child together, live in two separate countries and never speak to each other. All that having a child together proves is that the couple slept together at one time. I purposely pointed this out to the op because of the 2 year gap in her timeline.

In and of itself, having a child together is no assurance of a successful visa process but it IS powerful relationship evidence. If you think there is something about THIS case that would discount that evidence, you may well be right. Please explain more fully.

01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)

There is no 2 year gap. I have not gone back to the US since meeting my wife. We had originally decided to live in Vietnam for a couple of years so we did not file the I130 until recently.

The significant time together in Vietnam living as husband and wife, is far more compelling relationship evidence than the child together but combined, they are quite powerful.

That's how we feel too. I wanted to stay here to help my wife raise our daughter. Now onto counting the days we have left in Vietnam... :)

My wife and I lived in America 3 years then moved to New Zealand; had a baby and have been here in New Zealand 4 years and counting down the days till we can leave.

Already have been granted a greencard in 2005 but abandoned it when we came back to NZ to live; got interview in a couple days for my IR-1.

So there is a 2 year gap between your getting married and filing the I-130, which is what I said.

No, it's not what you said. You just mentioned a two-year gap without knowing the circumstances. You considered it a bad thing, when in fact, it was a very good thing, in terms of spouse immigration, the very best of things.
