We sent IR-1/CR-1 and K3 at the same time, now we got noa1 for both of them. what we need to do to Inform USCIS we will just continue the k3 instead of IR-1/CR-1? I would like to continue the IR-1/CR-1 but it will just take us further delays because we need to apply and pay another one for my daughter (child from previous relationship). Where as in K3 my daughter is already included in the application.Can we call Manila office for this? My husband is a natural born USC and is living with us in the Philippines for over 7 years now, can it affect his US domicile status? We have a son together and his philippine passport expired last June, do we still need it to be renewed since he already have a US passport?

huh? why not file the I-130s to US Embassy/Manila IV Unit, direct via DCF ?

from what i read the k3 is actually obsolete though USCIS still allows the initial application (for whatever reason) but it gets dropped along the way and they continue with ur IR-1(you already married more than 2yrs). i hope u get better answers

YOU don't decide anything yet. USCIS will process both petitions and send both petitions to NVC, if NVC doesn't close the I129F (like they usually do) then you may decide then

PS - USCIS cannot process the I129F without the I130, so that is why you do not or cannot notify them

Since a child is involved, I suggest you file an I130 for the child now. If the I129F gets closed, like it has been for almost 2 years, you'll be scrambling to file then for the girl.

I suggest strongly,

that you forget about what you filed INTO USCIS.

Simply remove it from your mind.

Then

Make a new set of I-130's - one for each human,

and submit them (with monies) into USCIS office inside of the US Embassy Manila.

Yer USCitizen Spouse NOW qualifies to file via Direct Consular Filing,

so - prep this weekend, file next week - and within 3 months all is finished.

Forget about USCIS in the USA, for now.

I know, I know - you and your husband made the wrong decision, to send all into the USCIS lockbox address in the USA.

It's OK. You really want to do something else now, so study up about DCF process in Manila.
