hey guys i am worried about this issue my wife been filing single head of house hold and i am filing single for the last 2 years,the reason we did that is the moron tax preparer who said our marriage is abroad and we can file as single,so we did what he said for 2 years,now will this cause a problem when i apply for naturalization in dec 2012 ( 3 year marriage) let it be known i have a kid and she is pregnant we have lot of evidence.i need an answer how far uscis go with tax records or do they require it from me?

Your moron tax preparer if professional, charged you, should be held liable for your back taxes due. Depending on your income, may be one hell of a bill as filing head of household is practically the same deductions as filing married on a joint return. Can even be more complicated if you have state income taxes to deal with.

What I find criminal, the IRS has over a thousand different forms and some odd 13,000 pages of tax laws. That is a bit too much for anyone. In two short months, here we go again. Don't want to mess around with the IRS, can take everything away from you, and bankruptcy is no option.

It can cause pretty big issues and your tax preparer is a :bonk:. Find another preparer, file amended tax returns, and file JOINTLY. It is completely irrelevant whether you got married abroad or not. Married means married and USCIS wants to see that. Also, married couples generally pay less taxes.

why not work up some 1040X's, prior years, and see what the math looks like, set as 'married filing jointly' ??

as to this thing '3 years married'

recheck please - it's 3 years from the first issuance date on the first green card, and NOT this '3 years married' thing that you mention.

You share the same responsibility the tax preparer does. And yes having filed as a single on your tax return. You can still fix it. You do have 3 years to amend your tax return. Just amend it to married filling jointly and use the new amended tax return.

why not work up some 1040X's, prior years, and see what the math looks like, set as 'married filing jointly' ??

as to this thing '3 years married'

recheck please - it's 3 years from the first issuance date on the first green card, and NOT this '3 years married' thing that you mention.

i mean 3 years of residency or since i have my GC

,we will look with an office regarding the 1040x amended to married filing jointly and see if there is a diff we have to pay back,and this will be a bump with the uscis coz as i understood they don't want you to be owing any money to IRS at the time you apply for citizenship,correct me if am wrong or if anyone who did the n400 with only last year tax may reply please

1. getting the 1040x forms online

2. filling them out yerself

3. studying the math

4. comparing the difference

all before deciding to go forward with actually submitting the 1040x's into the IRS?

If you were in my shoes (cause I'd not be in yer shoes) that's what you'd be doing.

:) i will get the tax binders and do the math and i can get a view how much will i owe.before submitting the 1040x.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
