We plan on putting our I 129f in on Feb 1st...and I would like to go visit my man again by mid March (just got back from a 4 week visit Oct12th).This time,since I would fly over there (WA) for only a week I plan on leaving my son here in Germany.My boy of course will be listed on the inital I 129f.So now I would like to know how possible is it to get through,trying top fly in for a week before we even get NoA2 and without my son who's listed on the paperwork as coming to the US with me????

I've read only about people from Canada trying to visit thier fiances here in the US while the fiance visa petition was still being processed. The advice was to have plenty of 'proof' that you had reasons to return to your home counry with you at the POE. Flying in from Germany would seem to be alot riskier than trying to drive across the Candain border. It would sure be a 'bummber' to be turned around and have to fly back out.

From what I've read, I would not risk it while the petition is pending.

My advice on this matter is just based on what I've read here in these forums. Your question falls well outside any of my own personal knowledge on the matter, so wait for a better reply.

Hello,

Generally while your K-1 visa is stil in process they deny your entry in to the US. You need to have very solid reasons that this visit is just a visit and nothing to do with immigrating permanently. Then also it is hard to prove these things when the K-1 visa is already being applied for.

Generally, it is not advisable to travel during the I-129F period assuming approval will be in a fairly short time. However, in your case it seems unlikely that the state department will be aware of your pending application at the time of entry. I would suggest that you be well prepared to show you are intending to return home and that the visit is only for a short time (i.e. visiting friends). With your son still in Germany that would likely provide compelling evidence of plans to return, but not definitive. You should also be prepared with documents showing work, home, etc.

However, the best course of action would be to have your fiancee from America visit you in Germany. The costs would seem to be the same. We all understand how difficult it is to be apart from the one you love but doesn't a couple more months seem worth waiting for. I assume you intend to wed and hopefully plan to be married for a very long time. Why not just wait and save the money.

As you will be travelling using the Visa Waiver Program I would say that as long as you bring proof of significant ties to Germany and can demonstrate a solid need to return (I'd say your pending K-1 and your son would be a pretty cinvincing case !!) then you will probably have very few problems visiting.

Many people from VWP countries visit during the process (Including myself) and as long as you are fully prepared to answer any and all questions fully and honestly and can provide the proof I spoke about you should be good to go.

You are not staying for anything close to the full 90 days allowed under the VWP, nor do you appear to have any kind of history of multiple visits that could constitute abuse of the VWP. All of that works in your favour. A letter from an employer or school stating a date that you are expected back would be helpful as well. of course, you might not get asked to show ANY of this proof but having it ready will help you if needed.

I would imagine your son staying behind in Germany would be excellant proof that you intend to visit, and return. Seems those from the UK and Canada report few problems visiting while a K-1 is being processed and while this is just a guess, I would imagine German citizens would also have very few problems doing so.

Be honest at the point of entry as to your intentions for visiting. Don't offer more information than you are asked for.

All the advice indicates that you should bring plenty of proof you intend to return, have ties which would indicate you will return when you state you will etc.

Meauxna-yeah it will go through this time.The (soon to be) ex was served with the papers by the Pulaski Sheriffs Department last week,which means my man is divorced by the end of January.!!!!! Thank GOD!

He can't come to Germany to visit us because he'll start working as a Truck Driver next week and therefor wont be home much.(4 days out of 30).So that's why I'm planning on flying to the US in March to see him for at least 2 days.Two days are better than none.I know it seems insane to pay 600+ $ just to see him for 2 days but hey ........that's called love and being crazy about the one you love.lol.

I could fly by the end of January to be there for his divorce but then we'd be apart for 6 months again and that's just such an awful long time..........I just left him not even 3 weeks ago and such a long ti,me stretch seems so horrible to us right now........This has been going on for so long now with all the delays and problems we had to face (nothing in the relationship itself,just very unfortunate events that kept delaying everything.....).Maybe I'm just being foolish right now but I'm just not complete without Jim and it feels like half of me is in the US while I'm trying to get things straight here...........

I don't think you'll have a problem going to visit your fiance. I'm from Belgium and staying in the US now since mid september until the end of november. I didn't have any problems at immigrations at the airport. They asked me the reason for my visit and I said : visiting my fiance. I did bring a lettre from my work and some other things but they didn't ask me anything else. So go ahead, I would say. :energetic:
