Hi. My fiancé and I will soon be sending the I-129F packet for me to get the K1 visa. I am very much concern about the affidavit of support since I am from the Philippines and the Manila Embassy does not allow co-sponsorship, with this, I am very much terrified. My main concern is he has been getting a $10.50 rate for the last 3 years, so that means he’s earning $20,160/year before tax. But recently he got another job for an additonal dollar per hour and is now getting $22,080, the thing is he was hired part time by his previous job and he can work during his days off on his full time job. It’s 32 hours/month amounting $4032/ year. If you add his yearly income before tax it will be $26,112, which he passed the 125% poverty guideline for the household of 3 including me, he has a son by the way, under 18. My questions are do you think we are qualified? Based on his previous income tax, he didnt pass but now he has two jobs one full-time and one -part time. I hope you can help us. Just a little confuse and scared at the same time since there’s no option left cause our country is not allowing co-sponsors. Thank you very much in advance.

They only care about the current income, not past ones. If he is over the 125% poverty line for a household of 3, then it would be fine.

Remember you won't need it now to file the petition. You will need at the interview stages... around +5 months down the road.

When the time comes, he will not only provide his most recent tax transcript, but he will also provide letters from his employers and most recent pay stubs from both jobs. Those things will prove his current annual income.

We are also having problems with that. My Fiance's income is high above the poverty guideline,but he just had his first job last September 2011 and because of that,his income tax return shows his income for only half of the year.We are thinking that it might cause us problems cuz the consul might think that he cant support me and so we are planning to do that Co-sponsorship but is it really not allowed here in the Philippines to do that and why?

It is not a problem if you present it correctly, Tax transcript, letter from employer (stating position, date started, current salary), recent pay stubs.

You do not need a co-sponsor. Manila rarely accepts them anyway. His income is well above the 125% requirement. He has held his current job for a year now. I do not know why you keep harping on the 2011 tax return. His CURRENT income is what matters. The letter from his employer and recent pay stubs show what his current annual income is. They will not skip over the fact he has had a job for a year and makes more than enough. It is not about his past income. What matters most is his current, ongoing income.

If I show a title to my property and statement from my realestate agent showing estimated value of a paid off house and from the bank within a 4 month period n bring 4months worth of bank statements with ending balance of $5000 in my savings account a job letter will that be suffient ? Pls help me out here.

It depends. Assets are used at 3 times their value to offset a shortcoming in income. To use the net value of your home, you must include proof of ownership, an appraisal by a licensed appraiser, and proof of mortgage/lien. Only assets that can be turned to cash within a year without hardship are considered. See the I-864 instructions(page 8) for details on using assets: http://www.uscis.gov/files/form/i-864instr.pdf

An example for using money in savings: If you make $17,000 but need $19,000 for your household size, then you would need 3 times the $2,000 shortcoming in income. So, you would need at least $6,000.

You mention a job letter. If you make enough income to cover the 125% requirement, then you do not need to list or use assets at all.
