Hi VJ Members, Can somebody tell me how long will it take to receive the NOA1 after filing the AOS? and does k-1 needs an interview? what if you don't have joint account yet,or bank account because were waiting til I can change my name to my husband's surname...can somebody help me this matter??? and one more thing, we went to civil surgeon,designated by Immigration but we are very disappointed because I think they are trying to offer us a different job,the lady said she's been doing immigration papers for 20 years and started to arrange my documents which I know was already complete, she told me I need a form I-130 which is I know not for k-1 because we marry here at U.S not in my country, I know I-130is for k-3 and she said I need to pay her $400??? and she said I don't need Immunization???I was very confused because I'm expecting her to transcribe my medical and let me fill up the I-163 form but I can't understand what she's trying to say...she's very mean and she's a puerto rican.....so i don't have much time because it was august 14 and my 194 will expire 16 so we decided just to send a copy of my immunization from my country. If ever they send me a r :help: :help: :help: equest I should look for a better civil surgeon.

Your time line indicates you filed your I485, we received an acknowledgement quickly in about a week, never heard of any one ho did not have a k1 interview and almost all will have a AOS interview. You can have a bank account if you have a social don't need the same name, we changed the name after getting GC. You are all over the map talking about K1, AOS, K3 this is very confusing. Your I94 will expire in 90 days, and your I797 letter is an extension by the us attorney general allowing you to stay 1 year to get the GC done. If you follow the guides here you should not have to pay anyone other than the CS and USCIS fees.

OK, first things first as your flow of information is difficult to follow.

What Visa did you enter US on?

EDIT: I just read your timeline. You entered under K1

Don't worry about your I-94 anymore. You married within 90 days so you have met that requirement.

Please read here for Adjustment of Status for K1

If you had your medical done for your K1, then your medical is valid for one year.

If you did not receive all of your vaccinations, then you need to see a civil surgeon to complete the vaccinations only, not a complete medical. You should have a copy of your vaccinations with you. If you don't and can not get a copy quickly, then you may have to take them all over again.

Read the guide...... read the instructions for the forms to send in. I think you will then have a better understanding of what you need to do.

Don't worry about your I-94 anymore. You married within 90 days so you have met that requirement.

Please read here for Adjustment of Status for K1

Some civil surgeons hardly know what they are doing or just trying to play $tupid and play by their own rules. I was already frustrated coz most of the civil surgeon i called were all rip off and they were causing delays. I called the USCIS and reported it, thy advice me to report the civil surgeons with the USCIS in my area by applying for an info pass. They said that way they can investigate and also the USCIS will call a civil surgeon for you to go.

I even encountered civil surgeon who didnt even bother looking at the instruction I have and decline me offering to call the USCIs to be clear with the protocol, they told me they don't want to talk with them ..Unbelievable but this is true to experience. I am glad I found one civil surgeon who I convinced to rad what i got from the USCIS website, even yet it took me time to really tell them to rad coz they think they know better :D

NO you do not need to file AOS before I-94 expires. You entered legally under K1 visa. Do not confuse the requirement to get married within the 90 days with the timeframe to file AOS. There is no legal timeframe, but I would advise to complete as soon after getting married as possible for other reasons that I do not want to confuse you with at this point.

NO do not pay them to"fix" your papers.

Follow the instructions from the link I gave you. It is very well defined.

All you need to do is to complete the vaccination requirement. Specifically the ones marked incomplete. A civil surgeon does NOT concern themselves with other parts of the process.

If you only turned in the copy of you vaccinations from your country, you will get a RFE.

You MUST complete the vaccination requirements in order to adjust status.

It appears you need to find a competent civil surgeon to complete the vaccinations. You can go ahead and go to the Health Department and get the vaccinations that are incomplete. They will give you a vaccination record. Take your copy from your country in addition to your Health Department card to show the civil surgeon what vaccinations you have received. He will then fill out the vaccination record and give you a sealed envelope that you will submit with your adjustment of status package.

Definitely find someone else. That persons sounds like an unlicensed immigration "helper" and USCIS specifically warns against them.

You do not need a I-130.

Did you already send in your AOS forms? You can use your husband's last name on those forms for your GC will come in your married name. If not, try to get it changed.

You can call around for a different Civil Surgeon. There is a thread here called 'Civil Surgeons who don't rip you off" with recommendations.

It is possible for a person filing for AOS from a K-1 visa to have their interview waived. But having an interview is not a big deal and will likely cause you to get your GC faster.

You don't even need to see a civil surgeon IF your vaccinations are all good except some are "not age appropriate" (and still are). You can just submit a copy of your DS-3025 Vaccination record that you got at your K-1 medical.

Question is: is your vaccination record all good and is the only reason your doctor during your K-1 medical checked "vaccination record incomplete" because of the "not age appropriate" ones? (that was my case)

Sometimes they do, and sometimes they don't. The USCIS will let you know.

You can open a joint account using your maiden name.

You don't need an I-130. Don't pay her anything. She's a scammer.

At least she's right about one thing: you don't need any shots. You already got all of the necessary shots at St. Lukes. Also, you don't need a civil surgeon to transcibe the DS-3025 info onto the I-693.

It's OK to adjust your status after your I-94 expires.

You sent in the DS-3025 immunization document from St. Lukes, so you won't get an RFE.

Yes, some vaccinations are age-inappropriate, and that's why your DS-3025 says "incomplete." It's nothing to worry about. You don't need any more vaccinations. You don't even need a civil surgeon to transcribe the info on your DS-3025 to form I-693. Just send the USCIS a copy of your DS-3025.

So, does the Philippines always give all of the necessary vaccinations?

They never let you out of St Lukes without needing just one? Because USCIS has determined that vaccination requirements do not apply for K visas at the time of their initial entrance to the US.

Mostly, this is not adhered to because many panel physicians are in the practice of selling shots.

yes it was incomplete because of my age not appropriate..and said that applicant may be eligible for blanket waiver because vaccination not medically appropriate

yes I already send the AOS package and yes I use my husband's surname on it, only the civil surgeon was confusing me, because we called the Immigration to recommend us a civil surgeon here at florida but she is so confusing and she messed up my paper, I'm glad someone called her for a meeting and she ask me to come back afternoon, I know she's trying to make money cause we went there for medical purpose but she's offering to fix my papers and started to organized it..I felt something went wrong there so we didn't go back.

YES..... as stated multiple times now. There is NO legal timeframe to file AOS for K1. The main requirement is married within 90 days, which you did.

It is advised to file as soon as possible for AOS after marrying to avoid other complications as accruing more than 180 days of being out of status. But, since you are filing, there is no need to worry about that....
