i have a simple question about K1 visa

hi everybody

first i wanna thank you about been there to help .

i'm a moroccan , my fiancé is an american , we have meet in person 2 times i guess on 2007 when she was there visiting someone , then she came to visit me and my family like 3 months ago , i wanna know this : when she has been in therein 2007 she was visiting someone and they used the K1 visa to get married , but she never marry him , he is still in usa eligale she broke up wit him after he came there like a month , now we are planing to get married , she sayed that we can use the K1 , but i think that she used it once , it might effect us .....

i wanna know if that might effect us or no , and i wanna know what's the best for us , to applay for a fiancé visa or just get married then alpay for a spouse visa ?

IMHO I believe her past with the K1 and the fact you write he stayed illegally will have SOME type of influence on your interview either way you file. K1 or CR1 :whistle:

Timeline

She can file for a K-1 visa as long as it has been over two years since the last approval. USCIS will send you a letter informing you that you are the second person she has petitioned to bring to the US. If it has not been more than two years then she will have to file a waiver. The question of what happened to the other gentleman may still arise as she agreed to marry him within 90 days and did not do so. A reminder to her every US citizen is only allowed two petitions in their lifetime for K-1 visas.
