Travel!!

If my wife had a tourist visa, she would already have been here (or turned back at the POE, but we would have tried).

Then she would leave for a few weeks or so once her permission to stay was reached, then she would travel again (or be turned back again).

At the very least we would try.

USCIS:

06/06/2012: Sent I-130 to VSC (as LPR)

06/08/2012: NOA1 (Priority Date)

06/12/2012: Touched

08/20/2012: Mailed VSC request for Upgrade to CR1

08/23/2012: Opened Request with USCIS for Upgrade to CR1

08/27/2012: Got Email confirming upgrade to IR1/CR1

11/13/2012: NOA2

NVC:

11/16/2012: NVC Received (NVC # not ready)

11/19/2012: BOG number/IIN - Gave emails

11/19/2012: Choice of Agent email sent

11/20/2012: AOS bill invoiced

11/20/2012: AOS bill paid shows in process

11/21/2012: AOS package sent

11/21/2012: AOS bill shows PAID

11/21/2012: Choice of Agent email sent (again)

11/21/2012: Choice of Agent email accepted

11/23/2012: IV bill invoiced

11/23/2012: IV bill paid

11/26/2012: IV package sent

11/26/2012: IV bill shows PAID

12/07/2012: AOS accepted

12/10/2012: IV Accepted

12/10/2012: Case complete

12/13/2012: Interview scheduled

US Embassy Bogota:

01/25/2013: Lab Visit

01/28/2013: Medical

01/30/2013: Interview

02/05/2013: Email Waybill (5PM)

02/06/2013: Visa in hand

02/08/2013: POE JFK, NY

Update: I am in the US! Sitting at the POE airport as I write this.

They asked me why i was here, I said I was visiting my brand new husband and his family. Then we chatted a bit about that, how we met, how often we see each other, if he will petition for me.

I explained why he will not be filing the petition yet, the officer was very understanding and approved my stay ubtil Feb 15th, 2013.

She did not want to see my return ticket at all.

Thankyou all so much for the encouragment, I'm waiting for my new passport(with my now married name :dance: )then we shall book my flight over!!!

Im wondering if I should try a new POE? Or should I take a chance with RDU and that awful officer?????

That part is a personal choice but do carry both the old and new passports, so they can see you've come and, more importantly, GONE several times before. It makes it a lot easier for them to believe you will GO this time to after just visiting.

Facts are cheap...knowing how to use them is precious...

They might be able to see Mary Jones visited but your new passport won't show that Mary Jones is now Mary Smith or that Mary Smith has EVER been to the USA. If you're lucky, you'll get the agent that knows you. :-)

@jp and tee - thanks for sharing your lst of evidence toshow the officer! I will do the same as I am a housewife .will plan to visit US on December for 5 weeks. We are on our NOA1 right now for ir1/cr1 visa.

2010 - met in Kuwait and got married at Washington using previous b1/b2 visa.

2010 - back in Kuwait as husband and wife.

2010 - denied to renew tourist visa, lady in the embassy said was not eligible!? Lies! Wth! Traumatized :-/

2012 - applied for tourist visa again, strengthened by the Lord, armed with lots of prayer, got a b1/b2 visa for a year!!! Yey! Christmas here we come!!!

2012 - decided to get ir1/cr1, I-130 started.

2013 - still in ir1/cr1 process.

2013 - EXPECTing our first born !!! <3

Because your awesome and you love us more than we will ever know how to, please bless us and send our visa case to the fastest and bestest worker you got! But nonetheless, let Your will be done not ours. <3

USCIS - NVC

08/03/2012 - I-130 packet received by the Chicago lockbox (sent through FedEx)

08/09/2012 - Received Email of NOA1, routed to California Service Center.

08/08/2012 - updated online?

08/20-ish/2012 - Received Mail of NOA1.

01/18/2013 - Received Email saying I-130 approved NOA2

03/06/2013 - Received Mail of NOA2

03/09/2013 - Emailed NVC correction regarding wrong current address of principal applicant

03/09/2013 - Paid AOS bill $88 online

03/10/2013 - Emailed the NVC DS-3032
