Timeline

Just simple questions that i'd like people to share as much knowledge as they could

and sorry if i got straight to the point, so thank you in advance

1st Question :

does it look normal to get a period less then a month to appeal a NOIR from the USCIS?

2nd question :

any good ideas or advices on how to respond to that NOIR?

I just read, NOIR is the Notice of Intent of Revocation. Used when USCIS has previously approved and immigration visa petition and now is revoking it.

If a DOS (Department consular officer) discovers during the course of a visa interview that the underlying petition should not have been approved, or is no longer approvable, the petition may be referred back to USCIS. In such cases, the returned petition should be accompanied by a memorandum explaining the reasons the approved petition should be revoked.

1. Usually you are given at least 30 days. How long were you given? Maybe the letter took a while to get to you?

2. Entirely depends on why you got it. In general- throw everything and the kitchen sink at it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1. Normally 30 days from the time the letter is sent, so less than 30 days from the time you receive it. Note that they must actually receive your response no later than the deadline, so send a few days early.

2. The answer depends entirely on why you are receiving an NOIR.

the NOID,is notice of intent to deny.

Not relevant. This is a Notice of Intent to Revoke (the approval of the I-130 petition)

The visa has already been denied.

Yes your timeline is valid as others have stated. You have known what happened at the interview and should have been preparing for thing all along. This is where you get to send your rebuttal to their decision. It is a one shot thing, they will not come back and ask more from you. They will take everything you send in and go over it and see if it oversomes whatever proof they had to issue the NOIR in the first place. Assuming that it is the classic "relationship for immigration purposes" then here is where you send in whatever you have to prove that you have a real relationship and didn't sumbit paperwork just to help someone enter the US. Remember this is your only shot without forking over more money for another petition.

This will not be over quickly. You will not enjoy this.
