US Citizen Wants Divorce From Conditional Permanent Residence

At this point, there is nothing she can legal do to you, you have your GC and that's it. Unless there is some kind of evidence that this marriage was somewhat arranged to secure your immigrant status....!?

I was thinking the same thing. I'm not suggesting you answer this here, george, but give it some thought. Is there anything she could come up with that would suggest you had an arrangement to get your greencard?

I'm not saying there is, and like I said, don't answer it publicly if the answer is "yes." Just think about it so you're prepared for anything she throws at you.

Well, if you did not wanted GC then how about going home ? Shouldn't be a problem ?

Anyway - what help you want ? Marriage counseling - different forum then. How to stay in US - divorce and remove conditions with divorce waiver having proof of good faith marriage.

Honestly I rather be illegal and out of trouble than to face deport.. Then they have me on a list to be deport.. And it will always affect me... If I'm illegal and staying out of trouble they have nothing to hold me or reason to look for me unless I did something .... But to have the Uscis issue a deport for you is bad from what I heard.. My marriage was entered on good faith, nothing but pure love, I never thought of cheating and no I'm not looking for marriage conselling ... Although I love my wife she turned out to be someone I thought I knew very well..

No not at all their is noting or we have ever spoke that this is an arrangement business type... We were living happy and never had any fights I'm just so puzzle ... Pieces I can't even put together to figure out where I went wrong or has she fell out of love and met someone else

WOW! she is just stupid to send u an email like that. In a long term she doesn't deserve to be ur wife neway. I doubt if she ever loved u considering she asked for money 3 weeks after u getting ur GC. Save the evidence. If u share ur email passwords, bank pins etc etc, then pls change it now. U dont want her to login to ur account and delete all evidences.

Am I the only one questioning the fact that he has the permanent residence card and the marriage has only been 5 months, but he can file for ROC? Maybe the blackmail part is an extenuating circumstance, but it says on the USCIS site for AOS that the conditional permanent status lasts for 2 full years and then the ROC can be filed. If a divorce is filed before the 2 years, the conditional status is void. Just want the correct information to get to the OP.

You won't be out of status. You will have to file ROC immediately after divorce.

If I were you, I'd wait and give her time to file. I just think it looks better for you if she's the one who files. Plus it costs money and why should you be the one to pay it?

It's my understanding that if you get divorced prior to the 2 years, you still file for ROC. You just have to prove that the marriage was real and you entered it in good faith. USCIS doesn't force you to stay married to keep your greencard. Marriages fail all the time (50%, right?).

I do not have the USCIS link, but you can file for ROC even before the two year window closes, if you are divorced and can prove that the marriage was entered in good faith and not to secure immigration benefits. Divorce does not end the sponsor's committment to the affidavit of support, but there is no rule to say you cannot divorce after receiving a conditional GC. Many people have divorced and ROC-ed, though it is upto the USCIS to adjudicate whether the marriage was good faith.

The important thing is that, in case of a divorce, you do not wait for the two year window to open, but file for ROC as soon as the divorce is final and you have the papers in hand.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

The email/vmail of asking fro money is a death kneel to her, save it with all your power.

Dude, just do the divorce, no alimony, no chidl support, the business thing I think is small. You're in very good shape.

This was just a question for clarification, from what I have read on most of these posts, it seems you have nothing to worry about (regarding immigration, I am sure the problems at home are still horrible) since your marriage was real and in no way a business or LPR aquisition.

I would also wait for her to pay for the divorse. I recently got married as well so I feel your paid, but keep in mind you don't trully know who you married until you are getting divoresed. She must be under the impression she can have you kicked out of the country. Stay strong, change all your passwords and really consider pressing charges on teh extorsion/blackmail attempt, that is uncalled for, no one should be able to leverage immigration status for personal gain.
