I need some advice regarding my situation. My fiance is from Yemen living now in Saudi Arabia. I live in the USA. We met on a muslim marriage website and we both like each other and want to get married. We have been in contact via phone, webcam chatting, letters in the mail, blah blah. I want to bring him here so that we may get married. Although his job back home pays very well I wanted to stay in america and he agreed to come here. The problem is I dont know what visa to apply for. We tried the k-1 and the requirement state we have to have met in the last 2 years. we have been trying to meet but are finding it extremely difficult without him being able to come here to visit. First, the culture in Saudia Arabia men and women cant mingle and travel without a male family member. Second, I tried to apply for a visa to Yemen but no visas were being given out because of the civil war there. Third, I have epilepsy and my doctors find it too dangerous for me to travel without a companion and even to travel period.

Is there any way to get around the 2 year requirement? What other visas would we qualify to apply for?

Any help is appreciated..

He could apply for a Visitor Visa, but sounds a bit of a long shot.

If you could travel I would advise to try and meet in a third country that you can both get to.

I'm sorry I do not know a visa that you can get without having of met, unless he is able to get a tourist visa to the US?

You can try meeting on "neutral" territory - not USA, not Yemen - some other country. But you need to meet in order to apply for K-1. There are two exceptions that require a waiver:

1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.

2. If you prove that the requirement to meet would result in extreme hardship to you.

IMHO it will be difficult for him to get a visa. Considering the constraints you have, it might be easier for you to meet at a place where you can satisfy the requirements of the USCIS whiteout putting you at risk. Dubai, IMHO would be a good place should he not be able to get a visa for a western country. You would be allowed contact to get to know each other and also you would have adequate medical facilities if you should need attention while on the road. Make sure you get international medical insurance and secure a chaperon to travel with you. Although epilepsy may be debilitating at times, many do travel and lead normal lives while keeping their condition under control.

Agree with the above posters, Dubai is your best bet. As a USC you will be given a visa upon entry to UAE. Yemen is not a GCC state (yet) so your husband won't get automatic entry based on that but as a resident of KSA (which is a GCC) he might. He should contact the UAE embassy in Yemen to check for sure. If not, then he will need a sponsor but that can be through a travel agency or if he knows someone who knows someone in UAE. Being in KSA it shouldn't be too hard for him to figure out.

My fiance was living in pakistan at the time , when we were dating and finally when its time we both decide we should met each other, i have told him i rather have come visit me in Dubai instead of pakistan so me and him met in Dubai and spent 2 month together and now we are filing for K1 visa, so just like everyone esle is saying here i agree with them ur best choice to visit him for the first time is Dubai..

2. If you prove that the requirement to meet would result in extreme hardship to you.

Option 2 above looks promising, use question 18 on the application I-129f to explain why the meeting requirement should not apply to you. You might approach your congressional representative as well, and have them draft a letter stating that they know you have special circumstances. Take a doctors note or test results to the meeting with the congressional staff person in your district, and ask for their help. Each office has a staffer that specializes in immigration issues.

In your case I would try to apply for K1 and point out on your health condition that doctor does not allow you to fly as well it violate his culture.
