My husband was brought to the United States from Mexico when he was 2 years old. When he was 19 he got into a fight and ended up being charged

with assault with a deadly weapon other then a firearm and burglary. He served a year in county jail and was deported to Mexico in August 2008. We got married before he was deported and I filed an I-130. In July 2008 we got the approval notice. After that nothing was done since the whole deportation happened. I have spoken to a few attorneys and we have to file waivers for the 2 felonies on his record. We have a 3 year old daughter and we are all living in Mexico to keep our family together. I'm wondering if continuing the process is even worth the money or if he will just be rejected. Does anyone have any experience with this or any advice for us? Thank you.

Your case will depend on your hardships - which we don't know. You'll have to show how you cannot live in Mexico (difficult since you already are) and why you'll suffer extreme hardship if your husband is not returned to the US.

Now, if your husband interviews he will absolutly be denied. He has a 10 ban for the overstay and 2 felony charges. Your case is well beyond our help here. I don't think they waive charges like these. It would be scary if they did. Could depend on how long ago they were though.

OP said the charge was assult with a deadly weapon OTHER THAN a firearm (although I'm not sure if it makes such a differece)

His fist was considered a deadly weapon when he got

hit first. It's scary what the DA gets away with.

well it;s scary as a US citizen knowing they would allow convicted criminals into the country, no matter the weapon, he committed burglary as well

It was called burglary when all he did was look through a window

of a boarded up house. Did not take ANYTHING. Thought this forum

was for supporting people but I guess not. Geez....

Cant we just help people without being judgemental or jumping to conclusions.. It's always the same attackers.. you guys dont have lives? Seriously.. If you only intend to attack, then dont waist good webserver space...

This is not a forum to determine someones guilt, inocense, or whether due process was served or not; and your "holy'r than thou" attitude does nothing to further the objective nor does it make anyone bow to your ridiculous attacks.. Get a life...
