....or applying for the K1 visa and getting married in The US? Which is easier logistically? If it matters he is Peruvian. Also he applied for the 4th time last week for a tourist visa and was denied because his father has a green card and is living in Miami. I do not understand why this would matter but I suppose they think he would go and never leave. Even though the officer said he had everything in order to go.....Ufff so annoying. Do you think this will make a difference for applying for a fiance visa? Also if we are married can they deny him entry just because his father has a green card!? Thanks

You can marry where ever you like. Where do you and your fiance want to get married? Neither is easier, one takes longer, one costs more. You should also consider things like how important is it for your fiance to work once he moves to the US, how long you are happy to be apart and what your plans are after your fiance immigrated.

You can marry where ever you like. Where do you and your fiance want to get married? Neither is easier, one takes longer, one costs more. You should also consider things like how important is it for your fiance to work once he moves to the US, how long you are happy to be apart and what your plans are after your fiance immigrated.

Which one takes longer and costs more? It is moderatly important that he can work. Why would we have to be apart? After my fiance immigrated we might like to stay for a bit but then the idea would be to move to Asia or travel.

In Peru!

Then get married there! Do what you want in your life :) The upsides to this are the CR-1 visa is cheaper (though you will pay for you plane ticket to Peru which makes it about the same probably) but even better is he will become a Permanent Resident on arrival in the US and will be able to work and travel right away. If you did the K-1 visa, he would not be able to work for months and would be stuck in the US for a while. The time is takes is roughly the same for either choice (the spousal visa takes 1-2 months longer). Good luck!

Then marry in Peru and file a CR1. You will go back to the US (or stay with him there). He waits until it is approved and enters as a new permanent resident!

As was mentioned, it depends on how much time you want to spend apart. With the K-1/fiancé(e) process, the separation happens before marriage, assuming the petitioner is the sole sponsor and stays in the U.S. for much of the time because they're working. With the spousal petition process, the separation happens after you're married because you don't file the petition until after you have the marriage certificate.

Fiance visa costs more but marriage visa takes longer. You should check the dates because I do not think its a lot longer or a lot more expensive. Also remember your fiance comes into USA you two get married then file for your fiance's green card then 30-90 days later he or she can work. While with the marriage visa he or she can work right away. You should look into both options and see which is best for your personal situation. Remember if you get married in USA you can always have your wedding in Peru at a later date that in no way should be the only factor in your decision. Good luck!

We did K1, but in retrospect we both would have gotten married in China, cheaper and no rerun of AOS in USA.

Yes getting married outside the US seems to be the better option. There is no worry about us being sepperated because we both live together in Peru. Then when all the paperwork is completed we can both just go to the US together right? Then come and go as we please. Also we are not really in a hurry. K1 seems to be the option for people doing long distance where someone is already living in the US and trying to get them there. Right?

Oh my, Lucy! You live together in Peru!?! You didn't tell us that!

Of course getting married in Peru is better for you both, especially if you both live there now! Far cheaper and all of those other bonuses, and if we can blow your mind once more... it is probably faster too!
