My fiance and I would like to start the K-1 Visa application as soon as possible. He currently lives in Morocco but has recently been approved for an Italian visa. He intends to go to Italy soon but exactly when is uncertain. On the I-129F it asks for the location at which you would like the interview to take place. I am wondering if I can submit the forms with Casablanca as the location but change it later if my fiance is in Italy by the time the process reaches this step? Also, if I list a location in Italy and the interview is scheduled for a time after my fiance's visa expires, will his legal status in Italy affect the decision for the K-1 visa?

You didn't specify what kind of Italian visa he was approved for.

I don't think he can be interviewed in Italy if he only has tourist visa.

For IV interview to take a place there, he would need some kind of residency or at least work visa.

Hi Tygrs, I have a follow-up question to that. I'm a permanent resident of Singapore and chose Singapore as the location for interview. Will I need to follow the rules of the consulate based here or my country of citizenship (Philippines)? Hope you can enlighten me. Thanks. :)

It would be a tourist visa and he would be staying with family for a couple months.

So you're saying, interviews can only be requested in countries of legal residence?

He cannot have his interview in Italy on a tourist visa.

Yes, you can only request to have your interview in any country where you have legal residence; otherwise, the beneficiary will have to stay/come back to their home country for the interview.

Specifically, in your case, he will have to return to Morocco for it.

Yes if he had a six month visa that was valid at the time of interview. However that will not get you by the issues such as AP that are typical for people from certain regions. In fact foreign interviews can be worse, especially if it appears the person got foeign residence just to avoid being interviewed "back home" . If he interviews there and the work visa expires before he is out of AP ( which will take longer from Italy because they will have to request some data from his home consulate and that will be a lower priority than local cases ) he will have to arrange to get the visa some how.

This will not be over quickly. You will not enjoy this.

so is it possible to change the interview location? Would it delay the case? As an Iranian, we have choices between Italy, UAE and Turkey. I have chosen UAE, but was thinking maybe the process in Italy is faster. But it changing the location would delay the case, then not sure if it's worth it.

Yes, it is possible as long as you are a legal resident of the Country you'll want to change to interview too.

It might cause a delay, but you need to keep the following advise in consideration. You will, most likely, have a delayed case anyway, due to your nationality. NigeriaorBust explained it, perfectly well.
