Crying and frustrated. Fiancee is born in China, but live in Japan since child and has a Japanese green card.

The problem is that Fiancee doesn't have a birth certificate. I already got the K-1 package ready to go. She only has Japanese green card, Chinese passport, Chinese household certificate (parents name not listed).

I did hire an attorney that charged a ton, but it did helped a lot and attorney found and corrected a lot of my mistakes. But attorney is insisting on getting her birth certificate.

What should I do if we absolutely can not get the birth certificate?

Her BC is not required until the interview.

You dont need a birth certificate of the beneficiary at this point of filing the I-129F. That is something needed for later at the interview. There is plenty of time to try and get it... don't know whether in such case anything else could be presented instead. Maybe you should post in the regional forum and you might get some tips.

But def don't hold up the I-129F for that just now!

Your attorney is an idiot, You do not need her birth certificate for the petition, only yours OR a copy of your passport. Tell him to show you where it is required in the instructions or get on the ball and send it

You will no tneed hers until the interview and even then there are alternatives.

Fire the attorney, get your papers and send them.

Different countries have different procedures, bureaucracies and official documents. You need to find out which document in your fiancee's country is the equivalent of an American birth certificate. Not all countries issue birth certificates at all, mine doesn't. But all countries issue a document that details much of the same info about a person that a US birth certificate does.

I will take to attorney tomorrow and insist on having the I-129F package filed without fiancee's birth certificate. We do have copy of her passport, my US naturalization certificate, US passport, and everything else on step by step guide for I-129 F package from Visa Journey.com.

If they do require it, I assume they will send us "Request for Evidence". Fiancee is still trying to get the birth certificate, I believe we will get it in a few weeks.

Beneficiary's Birth Certificate not required to file I-129F. Just the USC/petitioner submits their copy.

I'm a Canadian beneficiary. We filed our package without a lawyer, and without my birth certificate.

Like others have said, it's not needed at this point. I have since sent away, and received a copy of the required version of my birth certificate, that's needed for my interview in CANADA: Vancouver BC location, US consulate.

As recommended, send your package off. Then work on getting a copy of your fiances birth certificate ASAP.

Check under the forum of her birth country, and folks on that forum should be helpful.

The lawyer works for you! Tell him to send it in. If he knew what he was doing, he would know that it is not needed until the interview. At least get your petition in so they can start processing it... You have a good 5-6 month wait to work on getting the birth cert for the interview. Good luck with all of it! good.gif

she has chinese registration book? this is called a hukuo book.

Inside of it is the city, and province .

It may be that she can get the birth certificate after all, with a bit of work at the Chinese Embassy somewhere in Japan.

Regardless, it is not needed for I-129F submittal.
