Hey guys, LOVE this site, so helpful! Also a LOT of info to go through! My husband and I got married April 12th and are now about to file the next set of paperwork. USCIS Canada office listed: I-130, I-485, I-131, and I-765. I wonder about the I-130, nowhere else I've looked says we need to file this form! My other question is about my last name, do I file the forms with my married name, or my maiden name? Thanks guys!

You file everything with your married name. And you don't file an I-130 if you came on a K1.

Excellent! Thank you! Do I have to file anything to show that my name has changed? When we married at city hall they asked if I was changing it and my hubby told them yes... but I haven't filed anything to the government saying I changed it.

Do you already have a US social security #? If you do, you need to change that to your married name, which you should be able to do with your marriage certificate and passport/I-94/K1 visa at your local office. If you don't have one, you should go to the same place and get one soon, when you still have plenty of time left on your I-94.

I'm going to go in on Thursday for my SS# application filing etc. Putting my married name as the one I want it under. Most of the application is blank though, since my parents don;t have SS#s. Looks odd!

I have a couple more questions! #1) I went and got my SS# but it is in my maiden name, they said I need to change my name with DHS before I can get one in my married name, how do I do this? #2) I don;t have a rental agreement, or my name on the mortgage/deed so I need an affidavit to show that I live here, but my husband and I are unsure how to do this, any help would be appreciated!

All the SS office should require is your marriage certificate to show the name change.

DO NOT file I-130.

For AOS from K-1, no proof of a bona fide marriage is required. Please read the instructions. You do not need an affidavit about where you live.

SS office is wrong about name change. Read in the "Working and Travel During Immigration" forum for some tips for training the SS employees. If they won't do it, it's no problem, though. You can change it later.

5/23/12: Sent out package
2/06/13: APPROVED!

Alright, thank you! I did bring a certified copy of my marriage certificate with me to the SS office, but they said my name is registered with DHS as my maiden name so I have to use that. My passport also confused them as it is a 5 year and not 10.

Oh! I thought of something else. For advance parole, we are planning to go to Canada in August for a visit so we know the dates, but I also need to be able to go at any time (my grandparents are in their 90s). Is this possible? This is the form that confuses us the most! Even the instructions don't really help.

Go back and try and get someone else to deal with you. Your marriage certificate should be proof of you changing your name. That's all I took to change mine.

Don't put a specific date for AP. I left the date part blank and put "Unknown, in case of family emergency" in duration.

I'm not married yet, but I went to the SS Card Center last week. I asked about how to do to change my name after I'm married, and they told me the same thing: I need to make the immigration paperwork first, and I will return to the SS office with my EAD and marriage certificate to do the name change...

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.
