husband refused a no immigrant visa.

well VJ members,my sister is a LPR and is married to the husband who is i another country, since September last year.She returned to the states right after the wedding as she didn't want to be a victim of losing her residency as she had been out of state for more than six months.She got pregnant and is due in June.The husband has a lot of projects going on and its not ready to move and live permanently in the state.Well the problem is,he applied for a non immigrant visa just to be there for the birth of their first child.He was refused the visa with the reason for the wife to file for him.What can he or my sister do ASAP for him to be able to visit and be at the birth of his first child?

She has to file i130 to get him to America from what I seen it can take anywhere from 8 to 10 months.Only way to shorten the process if she was having a high risk pregnancy.They could expedite the i130 in that case.That's what I know from what I have read on VJ.Soon others with more knowledge will come and advice you.GOOD LUCK

Wrong. The spouse is LPR so it takes currently at least 3 years for the immigrant visa - F2A category.

Timeline

Both CSC and VSC have a priority date of June and Jan 2011 respectively processing I-130 for LPR filing for a spouse, which means it will take at least year and half to process I-130.

Many people get refused non immigrant visas if they are married because they are assumed to be immigrants.

Expediting might be an option if you showed a real problem with your pregnancy. if not, nothing you can do.

I am sorry to hear that, but get ready to give birth may be through Skype as one of the members said.
