Well today was a real roller coaster day for me. I got up and e filed my 2011 taxes, roller coaster going up! Then I again read the posts about being self enployed and discovered that it is NOT your gross income but your adjusted income that is what matters and mine was well below the poverty level, coaster going down! I mean I freaked! I'm older and have no parents alive to co sign, should I ask my sister? Am I going to have to tell the love of my life it's over! OK, lets check my assets, I have money in the bank, I own a home hand in hand with the bank, can I swing this, how does it all work if you have to rely on your assets, my head is swimming! I searched this site for hours, asked for help, got some answers that pointed me to other information, none good for me! (thanks for the help A&B)I found the post about needing 5 times the differance in assets and thought I might still be able to do this on my own, roller coaster levels out! Then I realized the adjusted tax amount seems low so I spent all afternoon doing my taxes again on Turbo tax. Turns out they doubled my morgage interest. Funny but coaster is starting to climb, lets see how high. Well I have to pay a big increase in my tax bill and I am still about 6k below the minimun but the coaster did not fly off the tracks and crash and burn!

Now I need to learn how to proceeed. I have enoung in savings to cover the differance 5 times over for the 5 years and I asked my sister if she would co sign and she will if she can but questions came up I have not seen answers to so now I need the forums help

1.Without using a cosponser I don't meet the income menimum but have more he enough in savings and other assets worth over 100k, do I just fill out the 1-134 form with that info and submit it with the bank papers.

2.The form asks about personal assets but I don't see anything about proof.

3.One last question for now, sorry for the overload! If I go the cosponcer route, how long are they held responcible?

Assuming the co-sponsor you use for the I-134 is the same for when you adjust status and submit the I-864 (both the co-sponsor and yourself will need to complete this form), they will be responsible until:

When Will These Obligations End?

Your obligations under a Form I-864 will end if the person who becomes a permanent resident based on a Form I-864 that

you signed:

  • Becomes a U.S. citizen;
  • Has worked, or can be credited with, 40 quarters of coverage under the Social Security Act;
  • No longer has lawful permanent resident status, and has departed the United States;
  • Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status,
  • based on a new affidavit of support, if one is required; or
  • Dies.

Note that divorce does not terminate your obligations under this Form I-864.

You should be using your total Income, not your adjusted gross income. (Line 22 of 1040)

First, assets only need to be 3X the shortage in income if you're sponsoring your fiance, spouse, or minor child. The 5X rule would apply to any other type of relative or to a joint sponsor who isn't related to the intending immigrant.

Assets generally require two things; proof that you own them, and proof of their value.

For money in the bank, you'll want bank statements going back at least 12 months. They want to see what the balance has been over that time. They're trying to make sure you didn't temporarily borrow some money to qualify.

For real estate you need a copy of the deed or title, a recent appraisal by a licensed appraiser, and recent statements from every lien holder. The value will be the difference between the appraised value and the total of the liens. In other words, the equity.

You might also consider dropping some of those business deductions on your schedule C in order to boost your line 22 total income on your 1040. You're not required by law to take those deductions just because you're eligible to take them.

Technically, they will never be responsible for anything. The I-134 isn't legally binding. Things are different for the I-864, which you will be signing when it comes time to apply for a green card. The I-864 is binding until one of four events occurs:

1. The immigrant becomes a US citizen.

2. The immigrant can be credited with 40 quarters (10 years) of work credit through the Social Security Administration. In other words, once they have worked long enough to qualify for other SSA benefits.

3. The immigrant loses their permanent resident status and leaves the United States.

4. Either the immigrant or sponsor dies.

An immigrant spouse of a US citizen can become a US citizen in as little as 3 years. That's the bare minimum amount of time the affidavit of support will be binding. The potential maximum is the rest of your natural life.

Thanks for the information everyone.

L&T, sorry I am using line 22.

The problem with using me house is the equity, I'm like many in that the value of my house is probably less then the laon at this point. :-(

I do have enough in savings to more then cover the 3X problem, do you think this will be sufficient?

i have a litte confusion too about this I-134, i filed my 2011 tax and it's only 13k because i only worked for couple months, but now im full time and calculated my gross annually and totalled up to 22k, and my part time is around 5k annually, would i be ok? would they still give me hell about my 2011 tax return or they will look at my employer? and i have about 5k on my savings.
